You can't try a dead terrorist.

A judge today signed off on the feds' decision to drop hundreds of criminal charges against Osama bin Laden, more than six months after heroic Navy Seals killed the murderous al Qaeda leader inside his hideout in Pakistan.

The evil terror mastermind had faced prosecution in Manhattan federal court -- and a possible death sentence -- for conspiring in the deadly 1998 suicide bombings of U.S. embassies in Kenya and Tanzania.

The indictment also charged him with "al Qaeda's worldwide conspiracy to kill Americans," which peaked with the Sept. 11 attacks on the World Trade Center and the Pentagon.

Today's court filing notes that "while this case was still pending," bin Laden was killed May 1 in Abbottabad, Pakistan, "in the course of an operation conducted by the United States."

A declaration signed by Deputy Assistant Attorney General George Toscas says DNA samples from bin Laden's body matched a profile compiled from "multiple members" of his family, with the likelihood of a mistaken identification at "approximately one in 11.8 quadrillion."

Toscas said the results were further confirmed through "facial recognition analysis" by the CIA and statements by one of bin Laden's wives who was living with him inside the Abbottabad compound.

Court papers further note that "al Qaeda has itself publicy acknowledged the death of bin Laden," including a "recently released video" by his deputy, Ayman al Zawahiri, who this week was named al Qaeda's new chief.
