The Texas deadline for a qualified party to certify its pres & v-p candidates to the November ballot had always been 60 days before the November election, until 2005, when the legislature oddly changed it to 70 days. 60 days is September 5, 2008. But 70 days was August 26. Both major parties seem to have missed this deadline. The leading precedent on this is Fulani v Hogsett, which said that a minor party presidential candidate who is also on the Texas ballot does have standing to sue the state to enforce the law.
