OK that is sad to hear but I disagree that his family is suing the bat company. Next thing you know they will be suing the kids family for the kid hitting him.

Hell, these wooden maple bats are about as dangerous than metal bats now...

I feel awful for the family but suing the metal bat company is not the right move. At 12 years old, the mound should be at 60 feet.

man thats a sad story but who cares companies make a shitload of money. hopefully they get some money out of it. its wrong to sue the company but it doesnt really matter this time and age when you can sue any company for anything.

Hillerich & Bradsby said Domalewski's injury, called commotio cordis, happens more often in baseball from thrown balls than batted ones.

Think about this statement, in order for the ball to be batted, it has to be thrown, unless you are playing catch with someone else. I also find it sort of strange this family waits almost 2 yrs to the date of the injury to file a lawsuit against, the company that made the metal bat, Little League Baseball, and Sports Authority.

Personally, this seems to me a family who now just realizes that they will never get their son back to what he was, so they decided to file a lawsuit to get money to pay for the medical expenses, I believe there is a statute of limitation on things like this. I could be wrong.

I believe you have to sign a waiver when you sign your child up to play little league that you will not hold them liable for any injury that they might occur while playing. I believe that would include the equipment that the league also purchases. This should be interesting, especially if the parents signed a waiver assuming any and all responsibility.

Lesson to be learned here....READ THE FINE PRINT PEOPLE.
