Claiming the West Philippine Sea Islands & Shoals

Solicitor General Calida said Palace is preparing for diplomatic negotiations with China on West Philippine Sea. During the time the U.S. was operating 2 bases in the Philippines (Subic & Clark) the Americans used Scarborough Shoal (aka Bajo de Masinloc) as a target and bombing range. And they paid the Philippines for their use.

The Chinese govt should be reminded of the Chinese proverb that goes “Those who bully the weak are cowards before the strong.” Beijing’s commie bullies use military might to expel unarmed Filipinos from their centuries-long Scarborough Shoal fishing grounds. Yet they ran away from the strength of the Philippine case at the UN International Tribunal on Law of the Sea. Chinese officials must also be reminded of this speech:

According to the US EIA (Energy Information Administration), the real wealth of the area may well be natural gas reserves. Estimates say the area holds about 900 TRILLION CU. FT. (25 trillion cubic meters)–the same as the proven reserves of Qatar.

My answer in the e-mail on Sun, Jun 14, 2015 at 9:20 PM:

Yes. Pres. Truman under Proclamation 2667 in fact made the first claim beyond the traditional 12 nautical miles (22.224 kilometers) from the shore on Sept. 28, 1945. At that time the Philippines was firmly a U.S. territory. Therefore even if today’s Washington DC politicians are unaware, the oil, gas and mineral rich Spratlys are in fact owned by the Philippines an abandoned US Territory that I have promptly claimed.

The 200 nautical miles claim was also made by Chile on June 23, 1947 & Peru on Aug. 1, 1947. Later in 1982 the UNCLOS (UN Convention on the Law of the Sea) formally adopted the 200 nautical mile exclusive economic zone.

Attached is the map of the Philippines with the projected 12-nautical mile; 200-nautical mile and the Extended Continental Shelf at the theoretical 350 mile Exclusive Economic Zone (EEZ).

This is the dispositive portion of Proclamation 2667.

” Having concern for the urgency of conserving and prudently utilizing its natural resources, the Government of the United States regards the natural resources of the subsoil and sea bed of the continental shelf beneath the high seas but contiguous to the coasts of the United States as appertaining to the United States, subject to its jurisdiction and control.

In cases where the continental shelf extends to the shores of another State, or is shared with an adjacent State, the boundary shall be determined by the United States and the State concerned in accordance with equitable principles. The character as high seas of the waters above the continental shelf and the right to their free and unimpeded navigation are in no way thus affected.”

Here is why I have superior claim over all others:

– The People’s Republic of China (PROC) did not exist until 1 Oct. 1950.
– Malaysia did not exist until 31 Aug. 1957.
– Singapore of today did not exist until 9 August 1965. Singapore joined the Malayan Federation on 16 Sept. 1963 but was expelled on 9 Aug. 1965. This day became Singapore’s independence day.
– The Socialist Republic of Vietnam did not exist until 2 July 1976.
– The Philippine republic founded in 1946 by virtue of the Treaty of Manila is null & void. No referendum was held asking the Filipino people if they wanted to secede from the union (U.S.).

The Philippines is U.S. territory prematurely, irresponsibly and defectively granted independence in 1946. If China is NOT EVICTED from the Spratlys well within the 200-mile exclusive economic zone of the Philippines, this will lay the basis for China’s take over of Hawaii.

We have to remember Hawaii was not purchased. It was annexed in 1898 subsequently settled and became a state in Aug. 1957.

Chinese communist aggression is nothing new. Here is their track record.

China invaded Tibet in 1950; occupied Uighur in 1955; In support of the Khmer Rouge & its Cambodian genocide attacked Vietnam in 1979; declared Taiwan a runaway province in 1980’s.

Inhabitants of all the lands the US government purchased automatically became Native Americans whether they liked it or not. The Philippines along with Puerto Rico and Guam was purchased from Spain in 1898 for $20 million.

I am a Native American and I have superior claim over the Spratlys and the Philippines because the Philippines, my ancestral land, is in fact an abandoned U.S. territory. Yet today, ethnic Chinese and ethnic Spaniards control its economy and resources with the blessings of Washington DC.

The fact that the other Filipinos and Americans including historians, professors, scholars, journalists, business and political leaders are unfamiliar with our history is not my fault. These data are available for all to see.

Look at this Puerto Rico had a referendum on Nov. 6, 2012. Only 5.6% of the people voted for independence. The point being, they were asked to decide if they wanted to be independent. The Philippines in 1934, 1946 & 1986 were NEVER consulted if they wanted to leave the union (U.S.) and break their pledge of allegiance, (“one nation under God, INDIVISIBLE . . “)

Divide the whole non-Latino vote equally between Obama and Romney. Then give Obama 71% of the Latino votes while 27% go to Romney. That’s what happened in this election. In the meantime, Latino groups will be demanding payback/reciprocity.**

With regards to campaign finance reform, a fixed term of six years without re-election is another way of reforming campaign finance. Think of financing two campaigns as the two-term entrance fee to the White House. With a fixed term of six years, you pay 1 1/2 or less, instead of two entrance fees. The whole election system is beholden to Madison Avenue and the media corporations.

As part of the trade i.e. repossessing my ancestral land, the Philippines, the only abandoned US territory, I offered this to America on 5 July 2014. The US government seems to ignore my offer. I shall reclaim my ancestral land nonetheless. By the 4th of July 2015, it shall be one year from my initial offering. Modesty aside, the US government is not going to get a better offer than what I am offering compared to those who are now trashing my ancestral land.

Below is the link to my birthday gift to America in addressing Alan Greenspan’s concerns about the 2008 financial crisis such as how JP Morgan, IMF and even the Federal Reserve ALL failed to see the crisis coming! Greenspan said: “Not a single major forecaster of note or institution caught it.”

CERTAIN politicians, jurists, journalists and scholars are very critical about President Rodrigo Duterte’s policy in our territorial dispute with China over the West Philippine Sea (South China Sea). These critics are particularly unhappy that Duterte did not mention the Permanent Court of Arbitration decision that we won when he met with the Chinese leaders during his state visit to Beijing in October last year. They also criticize the Duterte administration for not including the South China Sea territorial dispute in the agenda of the Association of Southeast Asian Nations (Asean) summit meetings this year in which the Philippines could use to its advantage its position as chair of this year’s conference.

By the same logic, these politicians, jurists, journalists and scholars highly praise former President Noynoy Aquino and former Foreign Secretary Albert del Rosario for being “champions in protecting Philippine sovereignty over the West Philippine Sea”. Aquino and Del Rosario are cited for challenging China’s claim of sovereignty over the whole South China Sea in the Permanent Court of Arbitration at The Hague, and winning a decision in favor of the Philippines. A very patriotic and learned friend told me in an email: “I do not like Noynoy and Del Rosario on many issues, but I credit them for getting the arbitral tribunal decision in favor of the Philippines”.

On the surface, we cannot disagree with the interpretation of events by these politicians, scholars and journalists. However, if we analyze more deeply, we will see the irony of the facts. The reality is that Aquino and his foreign secretary caused the Philippines to lose sovereignty over the West Philippine Sea, while Duterte has successfully won back our sovereignty with his political wisdom.

The territorial and sovereignty dispute over the islets and shoals in the South China Sea has existed among China, Vietnam, Malaysia, Brunei, Taiwan and the Philippines for decades already. However, it is a fact that in the past 40 years, Vietnam had reclaimed more than a dozen islands in the Spratlys while the Philippines also made some land reclamations and built an airstrip in the Pag-asa islands. But it is interesting to note that before 2013, China did not reclaim any land in the whole South China Sea region. Another interesting fact is that over the past decades, the Philippine Navy and Coast Guards had arrested hundreds of Chinese fishing boats and jailed thousands of Chinese fishermen for poaching in the South China Sea area, but there was never a single Philippine fishing boat or any Filipino fisherman apprehended by the Chinese authorities. In essence, the Philippines had been exercising full sovereignty over the South China Sea in all those years. China had occasionally made protests but no action was taken to undermine Philippine sovereignty.

This situation completely changed when Aquino decided to rename part of the South China Sea as the West Philippine Sea. The Aquino administration refused to have any dialogue with Beijing, and China considered the Philippine government extremely unfriendly. Beijing started to dispatch ocean surveillance vessels to patrol the area which led to the confrontation in Panatag (Scarborough) Shoal in April 2012. When Aquino and Del Rosario decided to challenge China in the Hague tribunal, Chinese Coast Guards started blocking Filipino fishermen from fishing in the Panatag Shoal. After the Aquino administration solicited support from the United States and Japan to confront the Chinese, and when joint military exercises were staged by US and Filipino soldiers near the disputed South China Sea area, China started in 2013 big-scale reclamation to enlarge the islands under its control.

By igniting the fire of dispute and provoking the Chinese, Aquino and Del Rosario caused the Philippines to lose sovereignty over the West Philippine Sea, including the Panatag fishing grounds. Undeniably, renaming the West Philippine Sea and challenging China in the arbitral tribunal are just like cosmetic surgeries; they may make the appearance nice but can become hazardous to health. After these maneuvers, our poor fishermen could not go to the resource-rich Panatag Shoal for fishing, and China reclaimed so much land in the disputed areas and even built permanent structures on these reclaimed islands. In reality, the Philippines had lost territorial sovereignty due to our politicians’ ingenuity.

Apparently, Duterte has far better political wisdom in handling difficult situations. He seems to understand the mentality of the Chinese leaders and knows how to deal with them in order to achieve victory for ourselves. Duterte chose to approach Beijing with conversation instead of confrontation. The Chinese leaders reciprocated with an attitude of mutual respect. As a result, Duterte was able to win dignity and pride for our people and our nation. After his state visit to China, Filipino fishermen can now go back to the Panatag fishing grounds without any fear of harassment from any foreign force. China has suspended further reclamation in the South China Sea. In effect, Duterte has gained back Philippine sovereignty over Panatag Shoal and the West Philippine Sea which had been lost by the Aquino administration.

To achieve successful results in any diplomatic dealings, we should have a full understanding of our opponents. As I pointed out in an earlier article (“Understand the Chinese before talking to them,” Manila Times, October 15, 2016), the Chinese observe the “love begets love and hatred begets hatred” doctrine. The Beijing leadership abides by Mao Zedong’s teaching that “we will not offend others if we are not offended, but we will definitely retaliate when we are offended”. This political philosophy has been put into practice by the Chinese leadership in past decades, as shown in the history of the People’s Republic of China since its inception. China has showered many African and Southeast Asian countries with tremendous economic assistance in friendship and mutual respect. In recent years, the Chinese retaliated vigorously when they felt offended in the East China Sea and the South China Sea.

No one would question President Aquino’s good intentions and devoted efforts in fighting for Philippine sovereignty. However, his endeavors ended disastrously. On the other hand, the Duterte administration takes a low-key approach in fighting for our sovereignty. Some critics even label Duterte “defeatist”. But in effect, Duterte has won back sovereignty for the Filipino people. The Aquino administration did not understand the thinking of the Chinese and thus used wrong approaches and erroneous tactics in handling the crisis. Aquino and Del Rosario thought that by bringing the Americans and Japanese to our side, Beijing would bow to the pressure. But the result was to the contrary. Duterte is far more suave in his diplomacy. By advocating mutual respect, he was able to establish a friendly relationship with the “supposed-to-be enemy”. He not only regained sovereignty for the Philippines, he also obtained commitments and actions from China to enhance investment and trade development of the country. Critics should stop accusing President Duterte of being “defeatist”. In fact, his political wisdom and diplomatic achievement deserve high respect and full support from the Filipino people.

Nung panahon ni PNoy there was heated war of words between China and the PHILIPPINES. Pinaghuhuli pa natin yung mga Tsino at ibang mangingisda na taga ibang bansa. Meron nga tayong napatay na Tsino na taga Taiwan, if I remember right. PNoy's team took our claim to the Arbitral Tribunal. They won the case. Pero, anong nangyari? WALA, di ba! Di pa rin nakakapag-fishing yung mga mangingisda natin galing sa Pangasinan, Palawan, Zambales at iba pa noong panahon ni PNoy. A lot of good winning that case did us. NOT! Sabi ni PNoy we will take the high road and the diplomatic approach. Sabi ng China, "Thank you!" Pinadala pa ni PNoy si Del Rosario at si TROLLanes. What was PNoy thinking sa pagpapadala kay TROLLanes? Ganun ba talaga ka-BOBO si PNoy? After that debacle China started building structures on some of the contested islands. Good work, TROLLanes! Baka binigyan ni TROLLanes ng go signal ang China para magbuild ng runway. May dala ba si TROLLanes ng interpreter? Kalurkey to the max!
