Cybercrime Prevention Act or Freedom to Suppress Free Speech Act?

Republic Act 10175 or the Cybercrime Prevention Act of 2012, that will punish libel online and combat Internet-related offenses in the country, is now in effect all over the country. Among the punishable acts under the new law are offenses against the confidentiality, integrity and availability of computer data system, illegal access, illegal interception, data interference, system interference and misuse of devices. Also covered are computer-related offenses such as computer-related forgery, fraud and identity theft, crimes rampant over the Internet. Also punishable under the new law are content-related offenses like cybersex and child pornography, unsolicited commercial communications or cyber squatting. Cyber squatting is the acquisition of a person’s domain name in bad faith to profit, mislead, destroy the reputation and deprive others from registering the same.

The government classified cyber crimes in the Philippines into two categories: Internet and commercial crimes committed with the use of the Internet. Existing Philippine laws punishing Internet crimes are RA 9995 (Anti-Photo and Voyeurism Act of 2009), RA 9775 (Anti-Child Pornography Act of 2009), and RA 9208 (Anti-Trafficking in Persons Act of 2003).

The most controversial feature of this new law is the inclusion of libel as one of the crimes covered by this new law. Under the new law, unlawful or prohibited acts of libel as defined in Article 355 of the Revised Penal Code, as amended, are those “committed through a computer system or any other similar means which may be devised in the future.”

Our Constitution states that:

Section 4 – No law shall be passed abridging the FREEDOM OF SPEECH, of EXPRESSION, or of the press…

Will accessing adult sites be a crime now? Will our internet activities be monitored now? Will the government be spying on internet communications from now on? Will we now have to give our real name or reveal our real identity when registering to members-only sites? Will being anonymous on the internet be illegal now? Do we now have to give our real names and show our ID’s to internet cafe owners? So many questions beg to be answered as a result of this new law.

I see at least the part against libel in this new law clashing with the Constitution. This law could be used to harass ordinary netizens who are just expressing their opinions. This is definitely a threat to free speech. And how is the government going to enforce this law? The internet is a borderless entity. Is the Philippines going to be as draconian and as restrictive as China in controlling the flow of information thru the internet? Will our government resort to internet censorship or block certain websites that they will deem as libelous? This law opens up a Pandora’s box. It is just another tool in suppressing our freedom of speech and free expression and could be used to silence critics. Where are our Constitutionalists and conscientious lawyers? Is anyone not going to challenge this new law in court? Am I the only one who sees the chilling effects of this new law? Express yourself, people. It may be the last time you will ever be this free.

Sen. Sotto was one of the authors of this law/bill. So I will definitely not going to vote for him. :sopbox:
