The Constitution of the Imperial Union

Preamble
The Imperial Union is a Democratic State which allows freedom to its members. While allowing freedom, it uses restrictions to ensure a truly fair and just system. We of the Imperial Union strive to become the shining example of a true Democratic State. We promise fair and just decisions, and will give all freedoms to those wishing to reside with us.

Article 1. The President, Prime Minister, and Cabinet
(1) Executive Power
a. Executive Authority is herein granted by this Constitution to the President, Prime Minister, and Cabinet of the Imperial Union.

(2) The President of the Imperial Union
a. The President of the Imperial Union shall be elected to a term of 45 days, with elections being held every 40 days.
b. The President of the Imperial Union is the Head of State, and chief Executive of the Region, responsible for running the region and supervising the activities therein.
c. All laws must be approved by the President, should he veto a bill it will be sent back to Parliament.

(3) The Prime Minister of the Imperial Union
a. Following the Presidential Election and the inauguration 5 days later, the President shall select from among the members of the Senate a person to serve as Prime Minister of the Imperial Union.
b. The Prime Minister of the Imperial Union shall serve as chief aid to the President, chair of the Cabinet, and Head of Government.
c. The Prime Minister is responsible for directing the cabinet in implementing the President’s Agenda.

(4) The Cabinet of the Imperial Union
a. Following his selection, the Prime Minister shall assemble a Cabinet.
b. The Cabinet shall consist of no less than 6 members, they are:
i. The Prime Minister, chair of the Cabinet
ii. The Minister of Foreign Affairs
iii. The Minister for Immigration
iv. The Minister of Domestic Affairs
v. The Minister of Defense
vi. The Minister of Business
c. Each Minister will be give a portfolio (specific tasks and duties) by the Prime Minister and/or President, the portfolio will be related to his or her specific ministry.
d. The Cabinet collectively and the Ministers individually shall be responsible for advising the President on matters relating to the Minister’s portfolios and the Ministry’s area of responsibility.
e. The Cabinet may collectively introduce Legislation (Public Bills) into the Parliament on behalf of the President.

Article 2. The Parliament
(1) Legislative Power
a. Legislative Power is herein vested within the Parliament, which shall consist of two houses: a Senate and a Regional Assembly.

(2) The Senate
a. The Senate of the Imperial Union shall be the Upper House of Parliament.
b. The Senate shall be composed of 1 Senator for every 10 Citizens. This proportion of Senators to Citizens may be adjusted by law.
c. Senators shall be elected to a 60 day term, with elections being held every 50 days.
d. On the first meeting of the newly elected Senate, the Senate shall select from among their members a President of the Senate to lead the Chamber.
e. The Senate shall be vested with the power to introduce, pass, veto, and review legislation, and call new Senate Elections.
f. The Senate shall have full legislative jurisdiction over foreign affairs. The Imperial Union may not enter into an Alliance or military pact without the approval of the Senate.
g. The Senate may Order new Presidential election, with the approval of 1/3 of the voting members of the Regional Assembly.

(3) The Regional Assembly
a. The Regional Assembly of the Imperial Union shall be the Lower House of Parliament.
b. The Regional Assembly shall be composed of all citizens in good standing of the Imperial Union who are not serving as President, or Senator. In addition, no Judge may take part in votes within the Regional Assembly.
c. Every 20 days (which shall count as a session of the Regional Assembly) the Regional Assembly members shall elect a Speaker of the Assembly and 3 Assistant Speakers. The Speakers are responsible for managing the Assembly, supervising debates and scheduling votes.
d. The Regional Assembly shall be vested with the power to introduce, pass, and veto legislation.
e. The Regional Assembly has sole power to remove from office the Prime Minister and Individual Cabinet Ministers by a vote of no confidence.

(4) The Legislative Process
a. Each house and the members thereof shall have the right to introduce debate, amend, and approve Bills.
b. The number of sponsors needed for bills, the times of votes and debates, and the like shall be determined by the Houses of Parliament.
c. After a bill has been approved by one house it must be sent to the other for consideration, debate, and amendment. Once a bill has passed both houses it shall be presented to the President for his approval or veto.
d. Amendments to Bills must be approved by the House in which the bill originated before being sent to the President.
e. A system to number bills shall be developed.

Article 3. The Courts
(1) Judicial Power
a. Judicial Power is herein vested within the Supreme Court of the Imperial Union and the inferior courts that the Parliament may deem to establish.

(2) The Supreme Court
a. The Supreme Court shall hear all cases brought to it by the Government and private individuals and organizations.
b. The Supreme Court shall enforce the laws of the regions as they are written and enforced by the Executive.
c. Cases may be brought to the Supreme Court by petitioning the Court for a hearing.

(3) The Magistrate of the Supreme Court
a. The Supreme Court shall be presided over by the Magistrate of the Supreme Court.
b. The Magistrate shall be elected by direct popular vote to a term of 75 days, with elections being held every 70 days.
c. The Magistrate shall serve as chief legal advisor to the Presidents.

(4) Verdicts and rulings
a. Verdicts shall be issued by the Court enforcing the law.
b. Verdicts shall be decided by the Magistrate.
c. Verdicts may be overturned by an order of the Cabinet which has been approved by Parliament.

(5) Judicial Oversight
a. Oversight of the Judiciary shall be the responsibility of the Ministry of Domestic Affairs and its Office for Government Affairs.

Article 4. Political Parties
(1) Political Parties
a. Political Parties are organizations dedicated to representing and electing individuals who share common beliefs.

(2) Creation of Political Parties
a. Political Parties may be created by an individual after posting his or her party manifesto.
b. After posting a manifesto the party will be given its own forum.

(3) Electoral Participation
a. Political Parties may not participate in Regional Election unless they possess at least 2 members.

(4) Dissolution of Parties
a. If a party has not participated in at least 3 elections in a row due to membership, the party will be dissolved.
b. Parties that harbor or promote hate, injustice, and intolerance shall be dissolved.

Article 5. Elections
(1) Private Ballot
a. Each citizen shall have the right to private ballot and shall not be forced to reveal his or her choice in an election.

(2) Election dates.
a. Election dates shall be prescribed by law.
b. Elections for President and Senate shall not be postponed.

(3) Time of elections
a. Elections shall last 3 days.

Article 6. Emergency Powers
(1) Declaration of a State of Emergency
a. The President may declare a State of Emergency during times of:
i. Gross inactivity
ii. Infighting
iii. Attacks or threats of attacks.
b. The President shall issue a declaration to the Cabinet before issuing the declaration to the public.

(2) Powers granted
a. During a State of Emergency the powers of the Executive and Legislature shall be vested within the Cabinet and Prime Minister.
b. The Power to eject nations from the region shall be granted to the Cabinet during States of Emergency.
c. The Prime Minister shall direct the Cabinet and shall have the power to issue Executive Order to remedy the Emergency.

(3) Duration of a State of Emergency
a. A State of Emergency shall not last for more that 100 days.


Article 7. The Constitution
(1) Ratification
a.This Constitution shall be ratified by vote of the Parliament.

(2) Amendments
a. Amendments to the Constitution shall be submitted by individual members of the Region, the Cabinet, the President, or Senators.
b. Amendments shall be considered by the Senate before being put before popular referendum.
c. Amendments must be approved by at least 70% of voters to become law.

Article 1: Elections
Section 1
Elections are to be held every month. Nominations will start on the first day of every month. The elections will be held on the second day of the month, and the polls will remain open until the fourth day. On the fourth day a winner is declared and they will serve for the remainder of the month, until the following election.
Section 2
In the nominations, each Party must announce their Prime Minister and Minister (2nd in command) nominees. Posts made for nominations and candidacy must be made by the Party’s leader/chairman. . In the leader's absence, the next in command of the party is to make the post. Should the party have no chain of command, then a member of the party may post the nominations.
Section 3
Voting will be made via anonymous poll. If a user wishes to say who they voted for, and why, they may do so.

Article 2: Political Parties
Section 1
All users may join political parties. A party may reject a member from joining, as long as it within reason. Not all users have to be in political parties.
Section 2
All users may create a political party, but are encouraged to join one that is already established. In order to form a political party, there must be at least 2 members from that party.
Section 3
Users wishing to run for the office of Prime Minister or Minister must belong to a party, as they will run on behalf of the party.

Article 3: The President
Section 1
The President (regional founder) is to be he Head of State. The President cannot be impeached, overthrown, or reprimanded.
Section 2
The Presidential duties are primarily administrative. The President is to conduct voting, debates, and manage all regional information. The President also has a say in any matter. Although the president may state his wishes in any matter, that does not mean that his decision overrules any previously stated statements or decisions.
Section 3
The President may appoint someone to take his place in regional activity if he is going to be away. If the President does not appoint a specific person as a replacement, the Prime Minister will take his place in regional activity (not title).

Article 4: The Prime Minister / Regional Delegate
Section 1
The Prime Minister is to be Head of Politics.
Section 2
The Prime Minister will also be the Regional Delegate. Also, the Prime Minister will be in charge of holding votes on the WA resolutions. The Prime Minister will also be in charge of foreign relations, as in establishing treaties, and sending ambassadors to other regions.
Section 3
Any member of the Imperial Union may call for an impeachment of the Prime Minister, with a valid reason. If the motion is approved by the President, then a majority vote of 4/5 will need to be won in order for the said impeachment to be done. If impeached, the Minister will take the Prime Minister’s place, and the (new) Prime Minister may initiate a new Minister.
Section 4
All WA nations MUST endorse the Prime Minister (Regional Delegate).
Section 5
If the Prime Minister / Regional Delegate is impeached, all endorsements must be IMMEDIATELY removed.

Article 5: The Minister
Section 1
The Minister will act as a backup Prime Minister.
Section2
In the event that the Prime Minister is impeached, or cannot perform his duties for any reason, the Minister will take place of the Prime Minister, until the Prime Minister returns.
Section 3
The Minister may be impeached if President and wishes it.
In case of an impeachment, the Prime Minister will appoint a new Minister.

Article 6: The Rights and Restrictions of Users
Section 1
Active Users are entitled to certain rights and restrictions in the Imperial Union. The first of which is the Right to Post. The Right to post guarantees a user that if they have something to say, they can post it (within forum board rules).
Section 2
All users have the Right of Expression, meaning they may post anything as their Signature/Avatar as long as it is within reason. Things that are not "within" reason are to be determined by the Administrator and will be blanked out with little warning. This applies to, but is not limited to images or links to/of pornography and links to anything in violation of laws pertaining to digital content usage.
Section 3
All active users have the Right to Vote.
Section 4
All users have the Right to Role Play.
Section 5
All users have the Right to Dispute. All users have the right to trial, to appeal any action done from breaking a rule.
Section 6
All users have the Right to Proposal. This means that any user may post a proposal of a law for the Imperial Union. These proposals have to be within reason of rules, and must be supported by a reason as to why this law should be implicated.
Section 7
All users in the Imperial Union agree to abide by the Forum Board Rules, and the Constitution. Any user accused of breaking a Forum Board Rule or Constitution will be put before a jury of select individuals for trial. If the user is found guilty, the disciplinary actions will be decided by the President.

Article 7: Court of Law / Disciplinary Action
Section 1
The Court of Law shall be composed of the President, Prime Minister, Minister, and 2 users selected by the President. The users selected by the President will be 2 nations in the WA, or that have a high-level of activity in the Imperial Union. No 2 members can be consecutively chosen in the Court’s hearing.
Section 2
If the Prime Minister or Minister is on trial, then the Court of Law shall consist of the President, and 2 users selected by the President. The users selected by the President will be 2 nations in the WA, or that have a high-level of activity in the Imperial Union. No 2 members can be consecutively chosen in the Court’s hearing.
Section 3
The Court of Law has final Decision in deciding whether a person is found guilty or innocent.
Section 4
Disciplinary action for breaking of the Forum Board Rules or Constitution shall be determined by the President. The disciplinary actions include, but are not limited to: limited suspension from forum, banning from forum, limited suspension from region, banning from region.

Article 8: Constitution and Forum Board Rules
Section 1
The Constitution may be amended at any time with the consent of BOTH the President and Prime Minister.
Section 2
The Forum Board Rules may be amended at any time at the will of the President (Regional Founder and Forum Administrator).

Article 9: Emergency Powers
Section 1
In case of a threat from another region or nation (as in region crashing, or intruders looking to damage a nation or the region), Emergency Powers are given to the President, allowing him to eject and ban the threat from the region.
