 From doing a little research, Private Messaging on forums is a hot topic on a lot of support forums. I've seen both Zetaboards and SMF make some changes in the way pm'ing is handled, all of which I suspect of court actions. I wouldn't be surprised if Invision had a few lawsuits about private messaging. In InvisionFree, admins could view the pm's of their members, a feature that has been removed in Zetaboards so that the admins can no longer have that kind of access. And one that could be very easily abused.
