Man ticketed for Alabama DUI when riding a toy scooter A man accused of driving drunk on his battery-powered scooter rode the miniature machine into the McHenry County, Alabama, courtroom to prove it was not dangerous. While most people in the courtroom, including the judge, laughed at the display, it did not result in a lower charge for Carl Ahrens. Ahrens hoped the actions would show the judge the DUI ticket for riding the Raxor MX500 was unwarranted. The judge did not throw out the ticket for the DUI, though, as Ahrens did have a .18% BAC at the time of the arrest. Judge Thomas Meyers, despite his laughter, suspended Ahrens' driver's license for 6 months. Ahrens was given the ticket when he drove the toy motorcycle, less than 100 pounds, in a vacant lot in his neighborhood. He admitted he was drinking beer before the arrest. His young son, less than 2 years old, climbed onto his lap. A police officer pulled up at that time. The officer ticketed Ahrens for DUI and driving a motor vehicle without insurance or registration and endangering the health of a child. The defense wanted to point out the small machine only travels about 4 mph; they argued most insurance companies would not consider insuring the machine. Websites for the toy say it can reach speeds of 17 mph, though, which has led the city to consider the offense the same as driving another recreational vehicle or bicycle while under the influence. A ticket for DUI may be given in most states if a person is on any type of motor vehicle, despite the type of motor operating the vehicle. That means bicycling while intoxicated can be punishable as a DUI if the offense occurred on a public roadway. If Ahrens was in his driveway at the time the officer pulled up, the offense may have been punished very differently. While the prosecution is attempting to make a statement about how dangerous drunken driving is, many would question whether this ticket shows the severity and danger of DUI driving or makes a mockery of the arrest. Many people may interpret this arrest to mean a DUI ticket more of a joke than a serious criminal offense. |
