Thank you for getting back to me so soon regarding the outstanding FOIA request
for the WTC 7 south side (close up/lobby) photos and video. I placed a call to
NIST yesterday in order to receive an update of the fee waiver request. I will
forward anything I get from a release to you for dissemination.

On another subject, I read a message on your blog regarding the BBC early
collapse report and would like to send you some follow up questions that you may
be presented with following the airing of the documentary. The questions work
to eliminate any so-called "plausible deniability" which is a "Church Committee"
buzz word over here in the states.

In order to eliminate the plausible deniability surrounding this particular
aspect of your documentary please consider the following questions:

First- Regarding the Early Report of the Collapse:

"Conspiracy Files" claims that Reuters was the first party to state that WTC 7
(the Solomon Brothers Building ) had collapsed before it actually did,
Conspiracy Files attempts to resolve the issue with the following statement:

"It turns out that the respected news agency Reuters picked up an incorrect
report and passed it on. They have issued this statement:

"On 11 September 2001 Reuters incorrectly reported that one of the buildings at
the New York World Trade Center, 7WTC, had collapsed before it actually did. The
report was picked up from a local news story and was withdrawn as soon as it
emerged that the building had not fallen.""

1- When did Reuters issue the withdrawal of the story?

2-What is the process of issuing a story and withdrawing a story?

3- Who specifically at Reuters reported that the building had actually collapsed
after they picked up the story?

4- If there were rumors that the building might go all day, at what time did the
Reuters story get released, and who released it?

5-Is the statement that Reuters "issued" to Conspiracy Files contemporary (ie;
Is it a statement made now in 2008, or is there evidence that Reuters actually
withdrew the statement in 2001)?

6-Please show documentation from 11 Sep 2001 that Reuters withdrew the story
regarding the collapse of WTC 7 before it did.

7- Was the purported retraction by Reuters issued in the short time between the
initial false report of the collapse and the time of the actual collapse? (Data
is needed that show that a retraction statement issued in 2001)?

8- Where did Reuters "pick up" the story?

9- What is Reuters process of "picking up" stories?

Second-Regarding the Satellite Feed:

Satellite Feed cut out at 1715

1-On what information does BBC base that information on (the 1715 cut off)?

2-Must we take BBC's word on this, or is this information have a verified
source?

3- Please show us the verified data regarding the Satellite Feed timer from 11
Sep 2001.

Answers to the above questions now will certainly help to avoid the likely
influx of questions later, and may help to solve the matter without the
necessity of FOIA requests being issued in the UK.

Note from ferric oxide: This decision should be out Prior to the NIST report (according to the decision time frame). If it is a denial, I shall appeal to federal court before the NIST decision--Hopefully.

If the decision is favorable, then the data should be forthcoming shortly, and all data shall be freely and widely disseminated pursuant to the requirements of the fee waiver appeal rules. If the decision is not favorable, then its off to federal court.

So, NIST's argument is that normal office fires caused expansion and catastrophic failure. I suppose the south side damage argument may now be off the table. However, we will continue to pursue the photos. I'll post the administrative appeal soon. Remember that the fee waiver was denied based on the "dissemination" prong, as i am not the press. I did deal with the dissemination factor in the included endnotes, which were part of the appeal, but apparently they were disregarded.

This is a renewed request for just the photographs of the south side--in order to limit costs. The court costs involved with battling the fee waiver would not be condusive to getting the information released.

However, I can only hope that the timing of the initial request was such that NIST could not claim south side gouge damage without deceptive tactics subject to future sworn testimony.

Now I will attempt to get the disk full of south side photos without the requisite fee waiver request:

Below: NIST response to latest request for WTC 7 South Side photos. Photos have been confirmed, but are claimed to be held by (redacted) Corporation and cannot be released under an exemption as stated below. I will contact the corporation and appeal the decision.

The corporation in question offers many WTC photos for sale, so I will try this route as well. I see no reason why these newsworthy photos should be withheld, especially now that the NIST investigation is complete for the moment. The south side damage argument was dropped last year in favor of the cubicle fire argument. These individuals must be called to testify under oath, and a relevant representative has been asked to investigate several related federal agencies, due to their anomolous and potentially mischievious activities.

Thank you for getting back to me regarding the research into the photos of the
"close up" south side of WTC building 7 (Solomon Brothers Building). As you
know, my request for the information originated with NIST (National Institute
for Standards and Technology). They indicated that I should contact you to gain
access to the photos, which are also in their possession.

I am specifically seeking photos of the close up upper and lower lobby areas of
WTC 7 from the day of September 11, 2001. There was a triage located there at
9:30 AM on that date and their were photographers and videographers in the area
during the day. I have located rather distant shots of the south side of WTC 7
from the data that you sent to me. I will reference that data here so that you
may research the matter.

Your photo 0000381940-013 shows the south of of WTC 7 after the collapse of the
two towers, but the view is not from Vesey Street. It is quite a distance away
from the structure. The structure is in the background.

Your photo 0000381934-001 shows the south side of WTC 7 at a distance, although
both towers are collapsed (which is why WTC 7 is in view).

Your photo DWF15-164260 shows the Vesey Bridge which connects into WTC 7.

Your photo DWF15-157933 shows the Vesey bridge with a part of the east side of
WTC 7 on the right.

Your photo AADE001036 shows a collapsed WTC 7

The photos I am looking for are photos taken from Vesey street toward WTC 7.
There were photographers in the area in front of WTC 7 after the two towers were
hit. Your database shows photos of the two struck towers taken by a
photographer standing in the area in front of WTC 7 (Vesey Street).

I am seeking the shots taken toward the south side of WTC 7, in the lobbies
(upper and lower) of WTC 7 at "any time " during the day, including close up
photos of the south face.

of the WTC building 7 -, do you have sample images? Previously the
lightbox I sent contained images that were keyworded WTC. However if the
image does not contain the keyword it would not come up in the results.

I do not have sample photos from the close up WTC 7. NIST (National Institute
for Standards and Technology) does have the photos which were responsive to my
FOIA request. However, they are claiming an exemption under the FOIA and stated
that I needed to contact you to obtain the photos. I suppose that key search
words may be terms such as: Vesey Street Bridge, 911 WTC 7, Solomon Brothers
Building. I have not found close up photos of the WTC 7 south side lobby (upper
and lower) and close ups of the south face on 911 in your online database. They
do exist (as NIST has them), but they may be off line.

Thanks for any help you can give me. If you need photos of the south side of WTC
7 not on 9/11/2001 for reference, I can readily provide those to you.

Attached as jpeg files are a few photos of the WTC 7 south side for your
reference (pre-911). Please note that both the orange art structure (outside
the upper south lobby) and the Vesey Street bridge are present on the south side
of WTC 7.

I look forward to the photos which show the close ups of the WTC 7 south face
and the south side lobbies (interior and exterior) at any time during 911. If
you turn up WTC 7 triage photos that would also be helpful.

It is likely that most of the close up photos (online or offline) would have
been taken from Vesey Street, although there may be some close up telephoto
shots taken of the south face after the collapses of both towers. Presently,
there are rather distant photos available of the south side of WTC 7.

Note that a request for available news videos of this side (south side of WTC7)
was dropped from the original FOIA to allow a quicker response from NIST.
However, since there was at least one interview which took place near the WTC 7
south side triage area, the existing historic video will be requested in a
future FOIA.

Hello,

I appreciate the online shots and references regarding the south side of
Building 7. The one responsive photo that you graciously provided does display a
shot that I'd been seeking -- that is -- a photo beyond the east corner of WTC 7
as the photographer turned the corner and looked toward the lobby areas
(promenade), which are beyond the Vesey Bridge. There are color versions of the
east corner which were photographed by Bill Cirone and others in the area at the
time. Please refer me to any off line sources that you may have, so that I might
access photos of the actual lobby area in front of WTC 7, the triage area and
the south face of the structure.

Note regarding exemptions: If NIST decides to utilize an exemption in order to withhold certain photographs, then please note 5 U.S.C. § 552 (a)(6)(F)(b)(9), where it states: “Any reasonably segregable portion of a record shall be provided to any person requesting such record after deletion of the portions which are exempt under this subsection.” The amount of deletion should be indicated unless it would “harm an interest” protected by an exemption in the subsection.
