In order to help to determine my status to assess fees, you should know that I am an individual seeking information for personal use and not for a commercial use.
I request a waiver of all fees for this request. Disclosure of the requested information to me is in the public interest because it is likely to contribute significantly to public understanding of the operations or activities of the government and is not primarily in my commercial interest. I asked a reporter from the New York Times for copies of the responsive photographs from the Times archives if they were available. The reporter stated that I should request the photos from NIST. The photographs hold very significant historical value.

I request an updated status of my Freedom of Information Act (FOIA) request to the National Institute of Standards and Technology (NIST). The requested data is set forth below and is included in a certain fee waiver appeal, which was acknowledged by the Assistant General Counsel for Administration Office on September 17, 2007.:

I understand that courts have generally sanctioned a practice of handling “backlogged FOIA requests” on a “first-in, first-out” basis. Furthermore, it is my understanding that “the department of Commerce has a decentralized FOIA system and each bureau/administration may use two or more processing tracks to distinguish between simple and more complex requests.” Therefore, I request that you please identify the processing track for FOIA Log #07-76, and provide a general status of my request.


Moreover, I understand that Executive Order #13,392 states in part that FOIA requesters are “seeking a service from the federal government and should be treated as such.” In particular, there is an “overall policy”, which allows requesters to inquire “about the status” of an FOIA request. In light of Executive Order #13,392, I respectfully ask for an update of my Freedom of Information Act request.

I am still awaiting word of the appeal and the data from the south side of Building 7. In the mean time, here are some existing shots looking toward Vesey from the West side. One can see the smoke rising from building 6 and 5 to building 7 in these shots.

Above: This well known still from video shows two men chatting while standing atop the escalator landing on the WTC 7 south side upper lobby. A cameraman had sprinted into the lower lobby of WTC 7 and ran up the dormant escalator to capture this shot. The still (from video) is taken after the collapse of the South Tower, but before the collapse of the North Tower. This is the only released footage of the interior of WTC 7 on 11 Sept. 2001 to date. The entrance to the upper level south side WTC 7 lobby would be behind the cameraman. The man in the vest had just removed the device held in his right hand from over his head. The yellow pouch appears to have the letters B and U. The letter before the BU may be a Y, but is obscured by his arm.

Dear Senator xxxxx,

First of all, I offer my congratulations on the passage of S. 2488, the Openness Promotes Effectiveness in our National Government Act of 2007.

This law will enhance the Freedom of Information Act by (among other things) holding agencies accountable for their lack of compliance with the Act.

The establishment of the Office of Government Information Services in the National Archives and Records Administration to review agency compliance with FOIA is a great step toward ensuring public access to government records.

Senator, although this law went into effect after my own FOIA request (FOIA Log #07-76), I ask your help in expediting my request for information. Please refer me to the appropriate agency head, Senate sub-committee, or other outside agency that would be able to aid in expediting my FOIA request (FOIA Log # 07-76).

I have added an agency response to the end of this note for your reference. Note that the Department of Commerce stated that I would have an answer to my Fee Waiver appeal in two weeks. That statement was made by xxxxxx, Senior Counsel, Office of the General Counsel, General Law Division U.S. Dept. of Commerce in January 2008. It is now March 2008, and despite my repeated polite requests for status updates, the agency has not responded, even now that your sponsored bill is signed into law.

I am copying you on a letter sent to Senator xxxxxxxx, since you are the representative from my jurisdiction. I have a pending FOIA request, which has been acknowledged by the Department of Commerce. I am waiting for the requested information. It is FOIA Log #07-76.
The original request was acknowledged in September 2007, and my fee waiver appeal was also acknowledged.
I requested a status as to the FOIA request (Log #07-76), and the fee waiver appeal. Moreover, I was told by xxxxxxxxx, Senior Counsel, Office of the General Counsel, General Law Division U.S. Dept. of Commerce that an answer was forthcoming in January 2008 (see letter). I have not received any further updates or contacts from the Department of Commerce or from the FOIA Liaison as is required. I ask your help in expediting FOIA Log #07-76.

Dear Attorney XX,

I renew my request for an update of FOIA Request #07-76. On 17 Jan 2008,
Attorney XXX you stated that a response was forthcoming "within the next two
weeks," and it is now six months later, and I have not received a responsive
answer to my update request. My FEE WAIVER APPEAL was acknowledged in September
2007. I would appreciate any help you could give me regarding the status of this
request.

The substance of my initial FOIA request from NIST is as follows and dates back
to August 12, 2007, where it was acknowledged by NIST:


· Photographs and applicable video (in jpeg, mpeg or another format) of the
south side upper and lower lobby (inside and outside) of WTC Building 7 taken
throughout the day on September 11, 2001. These would be the photos and video
taken in the immediate vicinity of the WTC Building 7 south side upper and lower
entrances.

· Photographs and applicable video of the “WTC Division” triage area, which was
active at 9:30 am on September 11, 2001.

· Photographs of the upper and lower south side lobby areas (interior and
exterior) of Building 7 after the collapse of WTC 2, then after the collapse of
WTC 1. Note that NIST described the lobby area of WTC 7 after the collapse of
WTC 1 as having “no heavy debris” with a “white dust coating.”

Note regarding responsiveness to this request: Photographs may be redacted as
necessary and still may be responsive to my request. Note that photographs alone
may be responsive if video is not also available, and video alone may be
responsive if still photos (redacted or not) are not available.

I indicated to NIST that courts have generally sanctioned a practice of handling
“backlogged FOIA requests” on a “first-in, first-out” basis. Furthermore, it is
my understanding that “the department of Commerce has a decentralized FOIA
system and each bureau/administration may use two or more processing tracks to
distinguish between simple and more complex requests.” Therefore, I requested
that NIST identify the processing track for FOIA Log #07-76, and provide a
general status of my request.

Dear Sir:

I respectfully request a status update of my outstanding FOIA Fee Waiver Appeal.
Attorney xxxx indicated that I would have an answer in two weeks back in January
of 2008. I have repeatedly attempted to contact the FOIA Appeals office
(Assistant General Counsel for Administration) for an update via email with no
success. I have also contacted Attorney xxxx via telephone to ask for an update
and have not been successful.

I ask for your help in obtaining a status update. Note that the Fee Waiver
Appeal has already been accepted for review. I am simply asking for an update. I
thought it would take no more than 20 business days for such a review.

On September 17, 2007, your office acknowledged an appeal of a fee waiver appeal
(5 U.S.C. sec. 552).

In part, the acknowledgement stated that "a final determination will be issued
by the Department."

I have requested several status updates of this appeal via email, and have
received one response. Back in January 2008, Attorney xxxxxxxxxxxx wrote:

"Your fee waiver appeal is currently being processed. We expect to have a
response out to you within the next two weeks."

Although, I understand that such responses take time to process, I am simply
asking for an update for the fee waiver appeal.
