According to Cox and his father, Thomas Parks, who has spoken with his son at length about the incident, a police officer knocked on the window of the car. Henry, believing police wanted them to move out of the fire lane, started driving forward.

At that moment, a police officer – identified by authorities as Pleasantville Police Officer Aaron Hess – stepped in front of the vehicle with his gun drawn. Hess then climbed onto the hood of the car and pressed his firearm against the windshield, firing into the cabin of the car.
