You know this just annoys me immensely. It assumes we are still in an age where women prize their virginity. It assumes that anonymity is necessary because "no man will want a woman who is not a Virgin." Good luck FINDING a Virgin bride these days! Being a "victim" of rape...now...is like being a victim of robbery. Someone took something, maybe violently, that you didn't want them to have. But robbery victims are named. The is archaic. UVA’s Jackie Will Be Forced To Turn Over All Her Chats With Rolling Stone Posted By Blake Neff On 6:16 PM 01/13/2016 In | No Comments Jackie Coakley, the UVA student at the center of Rolling Stone’s bogus gang rape story from 2014, is going to be forced to turn over her email and phone records as part of an ongoing lawsuit. Rolling Stone’s article “A Rape on Campus” concerned the spectacular tale of “Jackie,” a UVA student who was supposedly attacked and gang-raped as part of an initiation ritual at Phi Kappa Psi fraternity, and then had her quest for justice blocked by indifferent and skeptical administrators. But after several weeks of intense outrage on UVA’s campus, follow-up research revealed that Coakley had basically fabricated the story, possibly as part of a bizarre catfishing scheme intended to win romantic attention from a male student. Now, Rolling Stone is being sued by Nicole Eramo, a UVA associate dean who says Rolling Stone defamed her by casting her as one of the story’s chief villains. Eramo is seeking $7.5 million in damages. As part of the lawsuit, Eramo’s lawyers have sought to make Coakley turn over her personal communications, alleging that Coakley is a “serial liar” whom Rolling Stone should not have trusted. Until now, Coakley had refused to turn over her email and phone records, with her lawyer claiming their release would violate Coakley’s “privacy and dignity” and cause her “extreme harm.” Coakley has also argued that because she claims to be a victim of rape that she should be protected from such an intrusive request. But U.S. District Court judge Glen Conrad is unconvinced. During a Tuesday court hearing, The Washington Post says, he said that he will make Coakley turn over all communications she had with UVA officials, Rolling Stone, or “A Rape on Campus” author Sabrina Erdely. Eramo’s lawyers have also requested Coakley’s communications with friends and family members regarding the article, but Conrad said he is undecided about making her turn over those. The contents of Coakley’s communications will likely be extremely important to the final verdict against Rolling Stone. Strong inconsistencies in her statements could bolster Eramo’s claim that Coakley was an unreliable source Rolling Stone should have known not to trust. Her communications could also disprove Rolling Stone’s claim that Coakley never mentioned the name Haven Monahan, a critical figure in her alleged sexual assault who turned out to be a non-existent person. Besides Eramo’s lawsuit, Rolling Stone is also fending off two other suits, one by three individual members of the Phi Kappa Psi fraternity, and one by the fraternity itself. The records were first requested in August. In November, the court said affected students could send in objections to the disclosure. On Jan. 12, the objections were heard in court. U.S. District Court Chief Judge Glen Conrad signed on Wednesday the order denying objections to UVa’s disclosure of the records on the basis of Family Educational Rights and Privacy Act. Affected students will have 10 days to review the records UVa intends to produce and to submit further objections. According to the order, all parties that were present at the Jan. 12 hearing agreed to additional protections for one of the affected students. The education records will be designated as “Attorney Eyes Only” and will have personally identifiable information redacted. Affected students will receive 24 hours notice before each submission. On Jan. 12, Conrad said that “Jackie,” the central figure of the retracted Rolling Stone article, “A Rape on Campus,” will have to turn over documents related to the article as part of the defamation lawsuit brought by UVa associate dean Nicole Eramo. |

U.S. District Judge Glen Conrad penned an order filed in federal court Monday compelling the cooperation of “Jackie,” the young woman whose account of a brutal gang rape at a 2012 fraternity party during her freshman year at the University of Virginia served as the centerpiece of a now-retracted article about the culture of sexual assault on college campuses. Published in November 2014, the article created a firestorm of controversy but soon fell apart under intense scrutiny, with Rolling Stone saying in December 2014 that their trust in Jackie was “misplaced.” In January 2015, Charlottesville police said it could not find evidence that the alleged rape ever occurred, a subsequent review by the Columbia University School of Journalism called the article a “journalistic failure” and Rolling Stone retracted the story in April 2015. In the aftermath, UVa associate dean Nicole Eramo sued Rolling Stone and the article’s author, Sabrina Rubin Erdely, for defamation. As the UVa administrator tasked with aiding sexual assault survivors, Eramo says the article portrayed her as uncaring and callous toward Jackie’s rape claims. She is seeking $7.5 million for the damage done to her career and reputation in the fallout of the article’s publication. Since her lawsuit was filed in May, Eramo has asked Jackie turn over communications related to her alleged rape, but after several unsuccessful attempts, Eramo asked that a court compel Jackie to cooperate. Jackie’s attorneys have argued that their client’s communications should not be turned over for three reasons — they are protected by a rule that precludes evidence related to an alleged sexual assault being admissible in court, they are irrelevant and unduly burdensome to the case, and that communications between Eramo and Jackie are protected by patient-counselor privilege. In his writings, Conrad disagreed with aspects of each of those arguments; specifically, Conrad noted that the federal rule protecting alleged victims of sexual assault from turning over evidence does not apply in “defamation action involving statements concerning sexual misconduct” if the evidence is deals with the veracity of the alleged offense. Further, Conrad said that rule dealt more with the admissibility of evidence than its discoverability, and that the patient-counselor privilege that Jackie’s attorneys argued for was unmerited, as Virginia Code does not extend that privilege to any authority, and because Jackie’s voluntary disclosure of her communications to Rolling Stone and Erdely would waive that privilege anyway. Conrad also wrote that many of the communications Eramo’s attorneys sought were very much relevant to the defamation allegations and that because Eramo and Rolling Stone have turned over their communications with Jackie, Eramo was entitled to corroborate those documents with Jackie’s. As such, Conrad ruled that Jackie would have to turn over all communications between herself and Erdely, Rolling Stone and Eramo, as well as all communications with UVa, as they relate to her alleged sexual assault. The judge partially granted the request for Jackie to turn over communications between “Haven Monahan” and Ryan Duffin, between “Haven Monahan and any other individual whose name was previously disclosed to defendants prior to the article’s publication” and between Jackie and any previously disclosed individual that mentions Haven Monahan. Duffin was a friend of Jackie’s around the time of her alleged rape, and Eramo’s attorneys contend that Haven Monahan was the moniker of a fictitious love interest Jackie made up. Conrad further granted a request for Jackie to turn over communications with anyone related to the original article, but stipulated that only communications made before Dec. 5, 2014, would be admissible and that they could not contain details of Jackie’s alleged assault. He denied a motion forcing Jackie to turn over any “Internet, message board, email and social media postings” in which she referenced herself as a victim of an alleged sexual assault on campus. All of documents produced, the judge said, will be marked as confidential and treated as such. Responding Tuesday, an attorney for Eramo said he was pleased with the court’s order. “Jackie was the primary source for Rolling Stone’s false and defamatory article,” said attorney Andy Phillips. “It appears that Jackie fabricated the account of the sexual assault portrayed in Rolling Stone and that Rolling Stone knew she was an unreliable source. Eramo had also requested communications between Jackie and the Rolling Stone author who wrote the story, which was quickly discredited and retracted, and communications with other U.Va officials relating to her sexual assault claims. To date, Jackie has not had to deal with any legal repercussions due to her flat-out lies. So, I doubt that Jackie understands the seriousness of what she has done. I bet she does not comprehend how very fortunate she is that the current political situation is such that she will not face charges due to her false allegations of rape. (Can you imagine all the money and resources that went into the investigation of a totally fictitious gang rape?) Now, she HAS to respond to a legal order to produce ALL of her communications with Rolling Stone OR face jail time. It will be interesting to see how she responds -- I just wonder if she appreciates the seriousness of this Judge's order and that she has to turn everything over. In late 2014, Rolling Stone published the Sabrina Erdely article “A Rape on Campus,” which recounted in gruesome detail Coakley’s alleged gang rape by several fraternity members, and a subsequent effort by Coakley’s friends and UVA administrators to sweep the whole thing under the rug. The story provoked a wave of outrage, until follow-up reporting revealed that Coakley’s tale appeared to have been a bizarre hoax intended to win the affections of a student she had a crush on. An investigative report by the Columbia School of Journalism excoriated Rolling Stone for lax editorial practices that allowed the deeply flawed story to be published. Rolling Stone is currently being sued for $7.5 million by UVA dean Nicole Eramo, who says “A Rape on Campus” defamed her by portraying her as callously handling Coakley’s supposed gang rape. As part of her lawsuit, Eramo has argued that Coakley was a serial liar whom Erdely and Rolling Stone failed to properly vet because they wanted to push her spectacular story. To back up her claims, Eramo has repeatedly sought to have Coakley turn over any communications she made regarding her alleged rape. Coakley’s lawyers resisted the request, arguing that her communications were protected as an alleged rape victim, blocked by patient-counselor privilege, or were simply irrelevant to a lawsuit against Rolling Stone. Jackie had a crush on her friend, Ryan Duffin, and catfished him by pretending to have a fictional boyfriend, “Haven,” who sent Duffin text messages revealing Jackie’s secret desires. Since Haven does not exist, all available evidence suggests these texts were actually sent by Jackie herself. She also claimed to be suffering from a terminal illness—and that she was the victim of a horrific gang rape orchestrated by Haven. Charlottesville police determined that the assault she described in Erdely's article never took place. Of course, for Eramo to win her lawsuit she must prove that not only is Jackie a liar, but that Rolling Stone acted with actual malice in choosing to believe her. |
