They can mandate coverages to the Insurance companies all day long - but someone is paying.

Hillary and the rest would have you believe it's magic that 26 year olds are included on coverage, and women don't get charged more, and there are 39 different types of contraception - but someone is paying.

The Gov't might reimburse, but where does the Gov't get its money.

The Gov't might reimburse, but where does the Gov't get its money.

They print it. I don't know why you still ask that question. It's not like half the country is not paying taxes. It's actually more than half not paying. Most of it goes to support the White House and it's staff......on trips and stuff.

I've read a couple articles that stated Hobby Lobby was decided under the religious freedom act, not the Constitution (First Amendment). That leaves my earlier posts due to be deleted!

Resources for a Potential Ruling Today in Halbig v. Sebelius

The D.C. Circuit is due to rule any day now, quite possibly today, on Halbig v. Sebelius....


This has the potential to bring Obamacare in way under budget. I'm hoping Halbig wins, but not sure what the DC Circuit would do with such.

In that situation, would the court immediately stop the subsidies through the federal exchange or hold off if Barry's crew filed an appeal with SCOTUS?

If the court were to end the subsidies, the left would cry out for an immediate solution to save the healthcare right a few million may lose or struggle with financially. The right may be pressured to offer a replacement for Obamacare instead of just disapproving of it.

At the same time, the left would be forced to take sides, which can't be good for Dem candidates.

Oh well, I'm counting the chicks before they hatch!

A devastating new Health and Human Services (HHS) Inspector General report released on Tuesday reveals that the Obama administration has yet to determine whether 1,295,571 of the over 8 million Obamacare enrollees are U.S. citizens lawfully in the country.

The finding, located on page 11 of the report, states that 44% of the remaining 2,611,780 application "inconsistencies" are related to verifying "Citizenship/national status/lawful presence." Another 960,492 application inconsistencies were related to verifying whether subsidy applicants provided accurate income information.

Moreover, the Inspector General report only covered the federal Obamacare exchanges to determine how the Obama administration resolved verification problems through December 2013. As for the 15 state-run Obamacare exchanges, the report says four--Oregon, Nevada, Vermont, and Massachusetts--are simply "unable to resolve inconsistencies."

As the Washington Post reported in May, as many as one million Obamacare enrollees may be receiving incorrect taxpayer-funded subsidies due to Obamacare's continued technical failures and inability to properly verify income and citizenship eligibility.

One year ago, conservatives warned that the Obama administration's decision to use the so-called "honor system" for income eligibility was merely a backdoor way to get as many individuals on the public dole as possible.

The Office of Inspector General determined that "the federal marketplace was generally incapable of resolving most inconsistencies."

Obamacare will cost U.S. taxpayers $2.6 trillion over the next ten years.

We had a Democratic super-majority pass a law. That law allowed Barry's selected staff to write regulations for policy qualifications. Now anything that crew wrote is a new right to campaign on preventing poor victims from losing to those terrible Christian corporations.

Report: Health law sign-ups dogged by data flaws

WASHINGTON (AP) — Many of the 8 million Americans signed up under the new health care law now have to clear up questions about their personal information that could affect their coverage.

A government watchdog said Tuesday the Obama administration faces a huge task resolving these "inconsistencies" and in some cases didn't follow its own procedures for verifying eligibility.

Two reports from the Health and Human Services inspector general marked the first independent look at a festering behind-the-scenes issue that could turn into another health law headache for the White House.

The inspector general found that key personal details submitted by many consumers — such as annual income and citizenship — do not match records the government has on file.

It also found shortcomings in the internal safeguards used by the federal insurance exchange and some state marketplaces to check the accuracy of consumer information.

Those personal details are critical because they determine whether an individual is eligible for taxpayer-subsidized health insurance, as well as subsidies for monthly premiums.

Digging out from under the data problem is one of the top challenges facing newly installed HHS Secretary Sylvia Mathews Burwell.

The administration says it is doing just that. Spokesman Aaron Albright said more than 425,000 inconsistencies have been resolved so far, more than 90 percent of those in favor of the consumer. The administration is hoping to clear up the majority of cases this summer, but may yet have to resort to an extension allowed under the health law.

The inspector general found that the federal insurance exchange reported a total of 2.9 million inconsistencies with consumer data from Oct. 1, 2013 through Feb. 23 of this year.

At the time, the administration had limited technical capability that would have let officials resolve roughly 330,000 of those cases. Only about 10,000 were actually cleared up within the period. Albright said the situation is much improved.

The inspector general said several states running their own insurance markets were having similar problems.

Most discrepancies dealt with citizenship and income information supplied by consumers that conflicted with what the federal government has on record.

The inspector general said efforts by the administration and states to clear up questions were complicated by lingering computer problems, including outages at the federal data hub, a key system that pings agencies like Social Security and the Internal Revenue Service for verification...snipped

Within 24 hours of the U.S. Supreme Court ruling that the Obama administration was wrong to impose its contraceptive and abortion drug regulation on small companies that oppose it on religious grounds, two federal courts granted emergency injunctions to seven non-profit groups that also oppose the rule.

In a July 1 news release from the Becket Fund for Religious Liberty, the non-profit law firm stated that the Eternal Word Television Network (EWTN) and five Catholic institutions in Wyoming -- Catholic Diocese of Cheyenne, Catholic Charities of Wyoming, St. Joseph’s Children’s Home, St. Anthony Tri-Parish Catholic School and Wyoming Catholic College – were granted temporary waivers from the mandate.

Also, a separate federal court granted a temporary injunction to Wheaton College to protect it from the mandate

In another news release, the Becket Fund called the ruling in favor of the Eternal Word Television Network, which was founded by a semi-cloistered nun, Mother Angelica, and focused on spreading the Catholic Church’s teachings, a “resounding victory for religious freedom.”

“We are thankful that the Eleventh Circuit protected our right to religious freedom while we pursue our case in court,” said EWTN Chairman and DEO Michael Warsaw. “We want to continue to practice the same Catholic faith that we preach to the world every day.”

“The seven religious institutions that obtained protection today join the 80 percent-plus of HHS legal challenges that have resulted in favorable rulings supporting religious freedom,” the Becket Fund stated, adding that “there are currently 100 lawsuits challenging the unconstitutional HHS mandate.”

Using an abortion-inducing drug, as well as other contraceptives, and sterilization, is contrary to the Catholic faith.

The Catechism of the Catholic Church teaches, "From its conception, the child has the right to life. Direct abortion, that is, abortion willed as an end or as a means, is a 'criminal' practice (GS 27 § 3), gravely contrary to the moral law. The Church imposes the canonical penalty of excommunication for this crime against human life." (2322)

The Catholic Church also teaches that deliberate use of a contraceptive or sterilization to "render procreation impossible" is "intrinsically evil." (2370)

The city of Berkeley will require medical marijuana dispensaries to give away two percent of the amount of cannabis they sell each year free to low-income patients.

The City Council voted unanimously at Tuesday’s meeting to amend the city’s medical pot rules, which would also allow for a fourth dispensary in Berkeley

“Basically, the city council wants to make sure that low-income, homeless, indigent folks have access to their medical marijuana, their medicine,” said Berkeley City Councilmember Darryl Moore.

Under the proposal, at least two percent of all medical weed dispensed at a club would have to be provided at no cost to very low-income members — and it must be the same quality that’s dispensed to regular paying customers.

“We think this is the responsible thing to do for those less fortunate in our community,” said Moore.

The measure also revisits definitions for cannabis collectives and dispensaries, patients and caregivers, on top of setting new rules for hours of operation and the methods for testing cannabis and edibles.

One Berkeley marijuana dispensary, the Berkeley Patients Group, already gives out free cannabis to the poor, and has for 15 years.

“We’ve found out over the years that one of the cruel realities is that when you do get sick and you have a serious illness is that it’s often hard to keep a job, can be hard to keep your income up, so those people really need the help the most,” said Sean Luse of Berkeley Patients Group.

The measure is set for final approval next week

If this falls short of a takings, it may become the new national healthcare plan!

More Legal Challenges Coming Against Obamacare

With the Obama administration’s defeat in Burwell v. Hobby Lobby, all eyes now turn to further Obamacare challenges. Chief Justice John Roberts shockingly greenlit Obamacare itself by converting it into a tax from a stated penalty, but he has also shown a partial willingness to chip away at the law.

There are two more upcoming cases on Obamacare worth watching. We can only hope that such lawsuits are just the beginning when it comes to the implementation of a law with regulations stacking up to eight feet tall.

Halbig v. Burwell: This case seemingly turns on a technicality, but it could completely sink the workability of Obamacare itself. The law allows for federal subsidies for those who buy their care through state exchanges; if subsidies are unavailable, those people can claim exemption from Obamacare penalties for hardship reasons.

There is one major problem for the Obama administration: 34 states refused to start state healthcare exchanges, and the law makes no provision for subsidies for those who buy their coverage through the federal exchange. That means that millions of people who applied for coverage through the federal exchange could be left without subsidies, freeing them of Obamacare penalties and destroying the base upon which Obamacare is based.

As Professor Jonathan Turley of George Washington University writes:

  • The administration's loss in the Hobby Lobby case is a bitter pill to swallow, but it is not a lethal threat to Obamacare. For critics of the law, Halbig is everything that Hobby Lobby is not. Where Hobby Lobby exempts only closely held corporations from a portion of the ACA rules, Halbig could allow an mass exodus from the program. And like all insurance programs, it only works if large numbers are insured so that the risks are widely spread. Halbig could leave Obamacare on life support — and lead to another showdown in the Supreme Court.
There are two other cases pending on the same topic.

Sissell v. Health and Human Services: The DC Circuit Court of Appeals has yet to decide on this case, which questions how Obamacare could be Constitutional given the Supreme Court’s bizarre reclassification of Obamacare as a tax rather than a penalty.

All revenue measures must originate in the House of Representatives, but Obamacare originated in the Senate. Pacific Legal Foundation is behind the case, and its principal attorney explains, “When lawmakers passed the ACA, with all of its taxes, did they follow the Constitution’s procedures for revenue increases? The Supreme Court wasn’t asked and didn’t address this question… The question of whether the Constitution was obeyed needs to be litigated, and PLF is determined to see this important issue all the way through the courts.”

Obamacare is a legal thicket that will only continue to rack up injuries – and accompanying lawsuits – as time passes. If the Roberts Court is more receptive to clipping away at Obamacare than it was to dismantling it, conservatives may yet have some legal hope.

Since Halbig is arguing read the law and Burwell is trying to interpret that Congress meant something other than what they wrote NINE TIMES, I think it is rather weak to call it a "technicality."
