Kirk Osborn - It's been four years

I just realized I forgot the date of his passing, March 25, 2007. It just doesn't seem right for me not to honor this man.

It's been four years.

When he passed we had a number of beautiful tributes.

For me he was crucial in understanding this case. Courageously he posted his motions and my fellow Liestoppers were given the ammo to attack Nifong's case. I don't know where we would be without him.

I like to think of him as the orginial Blog Hooligan.

RIP, Mr. Osborn. He kept his cool through Nifong's smirking in court and conducted himself with dignity and honor.

That probably was the most heartfelt article I wrote during the entire episode. I really liked Kirk, and he and I emailed each other a lot. He had represented Dawn Wilson in her appeal after being convicted of faux child molestation charges in the infamous Little Rascals case, and he and I shared a special loathing of Nancy Lamb, the best-known of the Little Rascals prosecutors, and an evil and wicked liar.

Kirk Osborn was a good man. Compare him with the scum that was and currently is inhabiting the office of the Durham County District Attorney's office.

Here's a article with a photo of Reade and Kirk in court the day that Stephens said he wouldn't fast-track the case and the NBP yelled, "Justice will be served, rapist!"

If you want to know why I have a special loathing for Durham, what Reade experienced that day is why. Not one person in Durham spoke out against what happened, no one at Duke nor any of the people who make up the "humanitarian left" crowd there.

Silence, in my view, equals endorsement. Reade Seligmann is a wonderful and decent young man, and Durham treated this fine person like utter dirt. There is and was no excuse for this. Durham really is a place where evil = good and good is regarded as evil.

True, there are good people there, as demonstrated on this board, but they are the exceptions. For the most part, Durham is the city of Victoria Peterson, Sidney Harr, Sam Hummel, Indy Week, Orin Starn, and the rest of that sorry gang that knowingly tried to frame kids for something that never happened.

Durham also is a place of kangaroo courts that remind me of North Georgia where Tonya Craft was tried. (Because I had lived in that area for more than 30 years, I was not going to be silent when the courts were trying to railroad an innocent person.) Reade's hearing, and what happened before and after, is how I always will remember Durham, North Carolina. In my mind, that is Durham and there is none other.

Just for the record, Sydney Harr lives in Wake County. However, too many people from Durham stood idly by while a grave injustice was done. The problem though is deeper, we stood idly by when Erick Daniels was framed. We stood idly by when Derrick Allen was framed. We stood idly by when Eve Carson's killers were walked out the door of the criminal justice system. We stood idly by while Mike Nifong lined his pockets in traffic court. And, while many voted against Tracy Cline, not nearly enough of us did.

It is important that good people make a stand against injustice whenever and wherever they find it - no matter how trivial or important it may seem to be. Unfortunately, this point seems lost on many. At present, I am involved in such a situation where I work. At first, many were just as riled up as I - but now, several weeks after the fact (and nothing has been resolved), most have lost that white hot heat of the moment and have come to the conclusion that it really doesn't matter and so have decided to accept the status quo. (There is also the fear that if one speaks out, one will lose one's employment - which, given the circumstances, not an inconsiderable fear). However, if one is unwilling to speak up or is fearful to speak up, what good can or will be accomplished? Instead, the forces of evil are allowed to triumph. That should never be acceptable.

I live inside of Fortress Left, California. But I must admit even "we" do not allow Grand Juries to operate without a transcript and they must inform the Grand Jury of any exculpatory evidence.. I still cannot believe that after 5 years this has not been corrected in North Carolina.

Kirk Osborn fight to get true information out was important. It helped break down the wall of mis-information that Nifong & the DPD were putting out. Nifong had been briefing reporters "off the record" about Crystal's horrendous injuries. Kirk Osborn posted on our old forum that when he saw the SANE Exam he was shocked, there was none. Normally he said there usually was something a client didn't tell him.

However not in this case as Reade was being honest, it was the DA who was being dishonest. What did Gottlieb & Himan tell that Grand Jury that sent out true bill of indictment? What did they not tell them about the April 10 DNA results from DNASI? What did Himan say about Dave Evans indictment a few weeks later?

Where has the movement gone to at the very least make sure NC Grand Juries have a transcript? NOWHERE. You don't want to have on record what PD Officers are saying under oath, do we?

Kirk Osborn legacy is in his life's work but one bill should be the Kirk Osborn Grand Jury Transcript Law. I doubt Gottleib & Himan would have testified if they knew it was being recorded and they along with Nifong had to reveal exculpatory DNASI DNA results. They couldn't have sworn they were telling whole truth, and nothing but the truth.

5 years since those dishonest indictments!

I also read your piece on Kirk Osborn. It was a moving article.

I also learned a few new things, most notably the fact that it was
Kirk who petitioned the court that all of the proceedings re: this
case be recorded. Indeed, that was highly critical. If there's
anyone who changed their story as often as Mangum, it was Nifong.
And, like Mangum, it didn't matter to Nifong if his "story of the day"
totally contradicted his story of the previous day.

My anger was directed at Nifong for a long period of time. Then
I started learning about Gottlieb, Levicy, Hodge, Burness, Brodhead, etc, etc, etc
so that lately my anger has not been focussed on Nifong.

But when I read your piece and was reminded of Nifong's courtroom antics,
my blood boiled all over again. Far be it for me to judge people relative to
the afterlife, but I have to believe that it will be easier for a camel to pass
through the eye of a needle than for Nifong to make it into Heaven.

Most of the lack of standing up for what is right is due to the preaching of POLITICAL CORRECTNESS over the years. This is especially true in Durham because of the city being mostly race equal. No one wanted to take sides, and besides, that is the way blacks have been treated forever. Silence does endorse. But unfortunately many people feel most comfortable with that.
