"Wasn't there an earlier report that the police also found a knife stuck into a sofa ?"

I got it now, the sofa cushion killed him in self defense!
Was this the the knife used in the fatal stabbing? I thought I read it on the board early in the sordid affair ?

Who is representing the sofa ?

Woody Vann must be on the hunt for clients at the moment considering his willingness to take state wages for the defence of CGM. What does that say about his current practice? Not Much.

So far the "sofa" has not been awarded counsel by the state. Stay turned, one never knows in Durham if a lawyer will show up to defend a case against the sofa for self-inflecting wounds. With respect to Crystal, everyone is a defendant. You remember that in her world, rape occurs while levitating so the accusation that a sofa stabs itself is not out of the realm of possibility.

Latest.......

The charges will NOT be upgraded until the autopsy comes back.

jmoo- they want to know if cardiac arrest kill him or was his death a result of the stabbing.

Help me out here LS lawyers.

If he did die of cardiac arrest.........whats next?

My question would be what was meant by "life suport?"

No brain waves?
or
After emergency surgery did he go to the ICU where a respirator is routinely used. Patients are kept in a drug induced coma to prevent the patient from fighting the respirator and trying to pull the tubes out.

IIRC, he had 3 cardiac arrests?
[pure speculation] The family may have decided to change his status to 'Do Not Resucitate.' The respirator would be disconnected and nature would take it's course (not always predictable). I wonder how long it was from the time he was disconnected and when he passed.

So what would have happened if Daye had stabbed Crystal? How would the reporting be? What would the charges and bail be?
.
I can tell you one thing, as sure as a Cat has Kittens, he would have more than that one lone charge against him.

And the D.A. wouldn't be entertaining any special yogaistics to see he is afforded every consideration a defense lawyer can imagine.

How many of the reports, medical, legal, autopsy, etc., will be available to the public?

I believe his appointment is the product of calculated back-room dealing. I suspect he will be remunerated in some fashion quite favorably for his beneficent "civil service".

I don't look for him to take a pay cut.

To me, it's clear, this cardiac arrest thing is on par with sending his body to London to see if he has a rare condition where his skin rips and knives grow out of his Chest.

It's the Crystal Mangum Defense, it's a plan.

I'll bet any amount of money If and when the autopsy report is released to the media the wral will post it just like they did with Eve Carson's autopsy report.

Who are Woody's other clients?

Mere coincidence if they are given a break on each of their cases?

What if an infection occurred that was life threatening as a result of the stabbing, does that mean that he didn't die of the original wound. He would not have had the infection were it not for the original stab wounds. This is straining a gnat in my opinion.
We are talking DUHS so an infection could very well have killed the late and insufficiently lamented Reginald Daye. So too some bad brake fluid or maybe someone gave him the wrong medications. But, intervening cause does not defeat the charge of murder or even manslaughter. First year Criminal Law exam question. There's probably a pattern jury instruction on it.

There is nothing sinister about waiting for the autopsy report. That is the standard procedure. In cases of suspicious death, the medical examiner or coroner will produce a report and, if the finding is homicide, then murder charges will follow. I am betting the pathologist will notice the additional holes in Mr. Daye’s body and find that discovery intriguing.

To clear up some other concerns:

First, it does not matter whether Mr. Daye had any preexisting conditions that may have made him more susceptible to injury or death. The law is that you take your victims as you find them. In any event, cardiac arrest just means his heart stopped working. It could have been from blood loss or shock. It does not mean he had any sort of heart disease.

Second, even if Mr. Daye did die from some sort of medical malpractice on the part of Duke Hospital as Mangum’s supporters claim that would still not be a defense to murder as Walt has said. Ordinary negligence in treatment resulting in death is considered a foreseeable risk created by one who inflicts serious wounds. Only if the injuries were trivial or the negligence gross, would it possibly be a defense.

On that score, for those who were saying, "She didn't kill him; she just stabbed him. He died at Duke. Maybe Duke killed him," this informational video might help.

Okay, I was just thinking that it is possible that there's a good
reason for both why they want to wait for the autopsy results
and why there is only a single charge at the moment:

Mangum's lawyer in the arson case argued that prosecutors and
the DPD were "guilty" of overcharging Mangum in the arson case.
It was an integral part of her final closing argument.

And, in the end, a majority of the jurors essentially agreed that
the charge of arson was "overcharging," and Mangum avoided
being found guilty of the more serious felony charge.

Perhaps, just perhaps, maybe they got stung by that, and they're
trying to be careful not to "overcharge" this time, so that she stays
in jail where she belongs.

NOT that I believe the Durham prosecutor's office deserves the
benefit of the doubt. I'm sure "they're just trying to do the right thing" :)
