Taken from a State of North Carolina Superior Court Division - Search Warrant - Probable Cause Affidavit, signed by a Judge and an Affiant on 3/27/2006:

QUOTE "The victim was treated and evaluated at Duke University Medical Center Emergency Room shortly after the attack took place. A Forensic Sexual Assault Nurse (SANE) and Physician conducted the examination. Medical records and interviews that were obtained by a subpoena revealed the victim had signs, symptoms, and injuries consistent with being raped and sexually assaulted vaginally and anally. Furthermore, the SANE nurse stated the INJURIES and her behavior were consistent with a traumatic experience." END QUOTE

That leave 2 possibilities:
1. She was raped at the Duke Lacrosse Party House, .......or
2. She was raped and brutalized and injured and while in a state of trauma and injuries, she still reported to dance at the Duke Party.

The injustice of this case is despicable.

Vann handled her earlier case when she was accused of trying to run over a police officer with a stolen taxi.

He said then he could bring ten character witnesses to testify for her. (I always wondered if one of those
might have been Cy Gurney; or even a family court judge...or an ADA named Nifong...)

He's not cheap, and how she afforded him back then remains a question...

The woman at the centre of the Duke University lacrosse player rape scandal could face murder charges after the boyfriend she is accused of stabbing died in hospital.

Reginald Daye, 46, died last night, almost two weeks after his girlfriend Crystal Mangum allegedly stabbed him in the chest with a kitchen knife after an argument.

Police said it was 'more than likely' the 32-year-old, who is being held in Durham County Jail, will now be charged with his murder.

Mangum was originally charged with assault with a deadly weapon with intent to kill after the alleged attack in the early hours of April 3.

Mr Daye was rushed to Duke University Hospital after his nephew called police. The nephew told officers the couple had been arguing about rent money at the apartment they share in Durham, North Carolina.

He said the argument became so heated someone had called police earlier in the evening, but they had left before the alleged stabbing.

WRAL reports he told officers: 'It's Crystal Mangum. THE Crystal Mangum. I told him she was trouble from the beginning.'

According to Anthony McCullough, Wilson’s cousin, the couple had only been dating for a few months but that the 46-year-old was excited.

He added: ‘I told him, with her background, you should be careful.’

Mangum has since been held on a $300,000 bond. Jose Lopez Senior, Durham Police Department Chief, told the Herald-Sun: 'More than likely, we will be upgrading the charge to murder.'

Her arrest came only a year after Mangum was found guilty of child abuse and resisting arrest, among other charges.

She was arrested after smashing the windscreen and slashing the tyres of her then-boyfriend’s car, before going on to set fire to his clothes while her children were in their home.

At the time she claimed her then-boyfriend had attacked her, which a jury dismissed, they could not reach a consensus on the arson charges so the case was dismissed.

Mangum became infamous in 2006 when she claimed three Duke Lacrosse players sexually assaulted her at a party.

Duke University lacrosse players Reade Seligmann, Dave Evans and Collin Finnerty were accused of raping her while she was working as a stripper at a party thrown by the team, the Duke Blue Devils.

The case caused a media storm over allegations of racism.

It was alleged the players had asked only for white or Hispanic strippers, but became angry when two black dancers turned up.

Prosecutor Mike Nifong indicted the three on charges of rape, sexual assault and kidnapping.

The university suspended the players, sacked the team's coach and eventually cancelled the entire lacrosse season.

But the case fell apart because of a lack of evidence and Nifong was forced to resign after scathing criticism over his handling of it.

He was convicted for contempt amid accusations he withheld DNA evidence and made false inflammatory statements about the players to the media.

State prosecutors who took over the case cleared all three of the charges, saying there had been a 'rush to accuse' by Nifong.

Afterwards, the three sued the university over their handling of the scandal, and received an undisclosed settlement.

At the time Duke University said it settled to 'eliminate the possibility of future litigation', and said it deeply regretted what the students had gone through.

Attorney General Roy Cooper declined to hold her accountable for her lies after concluding she probably couldn't tell the difference between truth and falsehood.

Now she's at the center of a homicide case.

It's the story of a life that spun out of control and hurt a lot of people.

Troubled? Maybe. There's no question she's trouble.

Are her behaviors the actions of someone who is disturbed, or dangerously malicious?

The courts will have to decide.

Supporters say he has done nothing wrong. Hardin is the victim, they insist, of friends who took advantage of his position and of prosecutors on his staff who abused their power.

“Jim is the kind of guy that every dad would want to marry his daughter and every brother would want to date his sister,” said prosecutor Mike Nifong, who has worked more than 20 years for three Durham district attorneys. “He’s a damn Boy Scout.”

The story starts with a tragic fire. On a cold January night in 1971, Hardin’s house in Durham caught fire. Jim, then 12, escaped from a second-floor window, but the fire killed his two younger sisters and his brother, who first smelled the smoke and woke the family.

Hardin’s mother, Carolyn Couch-Hardin, said the tragedy tempered Hardin and the family, forcing them to fight to overcome the loss.

Others saw Hardin’s compassion and determination, too. Some of the friends he made at a young age would work on his campaign, including Vann, whose father, Art Vann, was considered one of the state’s finest lawyers, and Candy Clark, whose mother, Angie Elkins, was a former member of the Democratic National Committee who stirred up votes for President Clinton.

At Duke University, his parents’ alma mater, Hardin was president of his fraternity. The fraternity’s adviser was Dan Edwards Jr., the district attorney, who hired Hardin as an administrative assistant for a year after Hardin finished at Duke.

The courthouse where Hardin learned to practice law was a place where prosecutors took care of their own. Edwards’ tenure was plagued by perceptions of favoritism, some lawyers said.

“The general perception in 1978 was that certain people were treated more favorably,
” said Nifong, the career prosecutor. “It was not uncommon to put all the felony cases on the calendar and do trials by ambush, and the chief prosecutor turned traffic court into his own fiefdom.”

After Hardin finished law school at Mercer University, District Attorney Ron Stephens hired him as an investigator. It was about that time that Hardin first talked of becoming district attorney, said Vann, the longtime friend.

In 1993, Gov. Jim Hunt appointed Hardin to serve as district attorney when Ron Stephens left to become a Superior Court judge. The lesson was clear, lawyers say: Big cases mean big promotions.

Meanwhile, Hardin was pushing toward his goal. He called on his friends to help his campaign. His family and mother - a member of the prominent Couch family in Durham - made signs and canvassed the community.

Back-room deals:

Wes Covington, one of Hardin’s closest friends
, helped raise money for Hardin and donated $500 to his campaign. But in September 1998, just two months before Hardin would run unopposed for district attorney, the State Bureau of Investigation started looking into allegations that Covington plotted to fix a drunken-driving case.

Hardin was never implicated in the case, but at the State Bar hearing, Covington testified that Hardin told him to lie on a dismissal form in another case and gave him special consideration because of their long-standing friendship. Other witnesses said Covington regularly asked Hardin for special breaks, telling Hardin that defendants could help his campaign.

Those same witnesses said, however, that Hardin told Covington he hated being put in that position and questioned why he should care whether defendants could help him politically. Others testified that Covington exaggerated his influence with Hardin and occasionally made comments to impress other lawyers.

“There is a possibility that the amount of influence Mr. Covington had was in his own mind,” said Orlando Hudson, senior resident Superior Court judge.

But even Hardin’s friends acknowledge that Hardin should have been aware of Covington’s reputation.

“I knew there was a tremendous gap between Wes’ image of himself and the image of him as portrayed by the Bar,” Nifong said. “Jim believes that everyone is as good-hearted as he is, and, to that extent, he can be taken advantage of by his friends.”

And Woody Vann has said that he has gotten special access and that Hardin has thrown out speeding tickets for lawyers as a professional courtesy. Vann also said that Hardin might unwittingly punish lawyers who threaten his political career.

“Defense attorneys that feel like they don’t receive additional treatment bring it upon themselves by pillorying Jim in the news media,” Vann said in an interview this year.

“If I say bad things about you, I don’t expect you to use your discretion to help me. We can’t ask him to be anything more than a good, decent, hard-working man with the same faults and frailties as anybody else,” Vann said at the time.

But what Vann calls faults and frailties other lawyers call favoritism that has clouded Hardin’s judgment.

“If he had any sense of right, he would step down,” said Alexander Charns, a civil-rights lawyer who has tussled with the Durham police and Hardin’s office over several cases. “You can’t base the awesome power of the District Attorney’s Office on friendship and cronyism.”

People close to Hardin say he has no intention of leaving office. The Jim Hardin they know is an honest, dedicated district attorney who wants to do the right thing.

“Mr. Hardin may have done favors for his friends, but those deals do not violate the law,” said Hudson, the Superior Court judge. “Every district attorney does that; it’s not an indication that Mr. Hardin is corrupt.”

[And you know how much we can trust Hudson's opinions on the law, grand jury protocol, enforcement of motions, etc.]

But Hudson added: “He [Hardin] may have also allowed people to get close to him that on second thought he would not, and he has changed that.”

[Why is a JUDGE, who is supposed to remain neutral, making comments about a DA who has to run for office? Isn't that against judicial ethics?]

Hardin is up for re-election in 2002. He’s likely to have opposition then, and friends say his recent troubles have cooled his statewide ambition. If Hardin stays where he is, his supporters say, he’ll still have the job he always wanted.

“He wanted to do this job out of love,’’ Nifong said. “He’s never wanted to live anywhere else. He has almost a romantic view of the district attorney’s job. You almost wished it was the way Jim thought it was.
