IIRC, that was the consensus here at the time...
I had completely forgotten about this case and didn't realize that a civil suit had been filed. Otherwise, I would have followed and posted it.

The folks at the Mercury News were really put out, weren't they?

There is a difference. Rape is defined as non-consetual sexual intercourse. Attempted homicide is the knowing or intentional taking of the life of another person. The disengenuous editorial writer is attempting to make a logical leap too far. And thus, his or her entire argument fails. Typical of the less than intellectually honest people inhabiting newspaper management these days, I am sad to say.

Ex-Duke security expert charged in Cary medical office break-ins

Cary, N.C. — A former employee of the Duke University Police Department was charged Thursday in a string of burglaries at medical offices in Cary, police said.

Shawn Michael Flaugher, 36, was arrested at his Benson home and charged with 25 counts of breaking and entering. He also faces larceny and drug charges.

Twenty-nine burglaries occurred at medical offices in Cary over the last six to nine months, said Lt. Steve Fonke of the Cary Police Department. The burglar grabbed cash and drugs in the overnight break-ins, he said.

The alarm systems to some buildings were disabled during the break-ins, and the locks to exterior doors were popped off, Fonke said.

Scott Mettler, who manages a building leased by Rex Healthcare where some of the break-ins occurred, said he was troubled by the way the burglar was able to get around building security.

"Our tenants, we want them to go home at night knowing that things are going to be OK in the morning," Mettler said. "We do what we can to protect our tenants, so it's disturbing to know that somebody had the ability to do that."

Flaugher was the manager of security systems for Duke police. He began working as a civilian employee of the department in February 2003 and left the department last month. It was unclear whether he resigned or was fired.

Wake deputy charged with embezzlement

Raleigh, N.C. — A Wake County deputy was charged Friday with stealing drugs and money from the department, authorities said.

Balinda Manley, 34, of 8401 Falcon Crest Circle in Angier, was charged with two counts of embezzlement and one count of possession with intent to sell and deliver marijuana.

Irregularities were uncovered during a routine evidence audit, and Sheriff Donnie Harrison asked the State Bureau of Investigation to look into the situation. The investigation is ongoing, authorities said.

The embezzlement charges involve 80 grams of marijuana and $6,433 in cash, authorities said.

Manley has been with the sheriff's office since April 2004.

Durham police sergeant charged with sexual assault

Durham, N.C. — A 15-year veteran of the Durham Police Department is facing sexual assault and kidnapping charges for crimes that allegedly occurred while he was on duty.

Sgt. Lester Rhodes, 42, was arrested Friday afternoon after an internal probe in connection with a complaint lodged on April 3, Durham police said.

"This is an ongoing investigation, and we are not releasing further details at this time to avoid compromising the investigation," Police Chief Jose Lopez said in a statement.

Rhodes, who joined the Durham Police Department in February 1996 and works in the Patrol Bureau, has been placed on paid administrative leave, a police department spokeswoman said.
