Why would he feel the need to establish that so publicly? Did he fear that some others
might be going to try to use her story?

I have never heard that detail suggested anywhere, but I wouldn't be surprised if you are right.

The biggest difference between this case and the many miscarriages of justice that preceded it is the inordinate amount of media coverage it attracted prior to trial. Most prosecutors and police do not seek attention when they are framing innocent defendants. Publicity increases the risk of being discovered.

The sheer arrogance of Nifong and the DPD is stunning. They acted as though they thought there would be no consequences if they were caught.
We can all agree (maybe) that nifong did not know anything about crystals claims until some hours or days after the party. He got caught up in the advancement of gottlieb's claim that indeed a rape occurred. Nifong took advantage of that for his election. What a deal for him. A white on black crime just before a big primary. Whoever wins the primary wins the election, right? Gottlieb, I do not beiieve, considered any consequences from his actions because it is still well known the DPD protects its own. They could do no wrong. Shelton was the oddball the night of the party so he was slammed to the pavement and run over. Shelton almost ruined what gottleib wanted the most. A busted Duke party. (erase the tapes, get that rape claim out on the listserv, lie and make crystal the victim, find her money).

It appears to me that it was easy to set up some party in Trinity Park without everyone throwing a tantrum. After all, they all had had enough of Duke students there. The fact is that gottleib maybe had a reason to try to make something go wrong at the next party in TP because he had motive. He was transferred out of that district at the request of Duke.

Question. When the cops arrived at 610 Buchanan Blvd were they looking for money that crystal may have dropped (lost) outside and around the house? Like Quasi asked. What were they looking for on the grounds around the house based on a 911 call complaint of racial name calling?
Gottlieb had motivation to set up or exploit the accusations re: the lacrosse party, but he seemed to have had a "working relationship" with the Trinity Park activists, such as Lee Coggins, well before the party. So the question regarding the frame is: Who was Gottlieb working for or doing the bidding of-- the TP activists or himself or some other entity?

I would hope that one of the many subpoenas to issue from the plaintiffs side would be TP litserv traffic along with email traffic among the Duke activists, TP activists, DUPD, DPD and CrimeStoppers.

On Friday, March 17, 2006, this was posted on the Trinity Park listserv by Durham Police Sgt. M.D. Gottlieb of District 2 Investigations:

The Durham Police District 2 Criminal Investigations Violent Crimes Unit is conducting an investigation concerning a rape of a young woman by three males at 610 N. Buchanan that was reported on 3/14/06 in the early morning hours. The female arrived at the residence for a party close to 11:30pm on Monday 3/13/2006 and left on Tuesday 3/14/2006 reportedly after midnight. Anyone in the area who saw or heard anything unusual, please contact Investigator Himan at 919-560-4582 x 229 or I at 560-4582 x 228. Thank you for your continued assistance.



Understand that this was days before the rape allegations became a news item. The first couple of responses criticized the landlord of the house and the loud parties, but these commenters were quickly put in their place by posters who asked where was their concern for the victim. This from March 20:


Come on now, my friendly neighbors. Who cares who owns the house? This is NOT about trash, noise, Trinity Properties, or anything else remotely related to Guy Solie. THIS IS ABOUT VIOLENCE AGAINST WOMEN AND SEXUAL ASSAULT, and potentially substance abuse.



There were no posts from March 20 to March 25, when the first details of the allegations were published, including allegations of a lack of cooperation by players, and a report of racial taunts by neighbors. Then it was wall-to-wall outrage. Like this one:


I am outraged. I am outraged that not one of the men on the Lacrosse team has an once of conscience to come forward. Shame on them. Shame on the parents who raised them. Who are this so-called “men” who shout racist slurs and have no respect for women, authority, indeed, for anyone? Who do they think they are?

My heart goes out to the woman who may have been assaulted (I say may, b/c no one has been convicted of any crime) and to the women who endured racial slurs and terror that night.

What does the community think of a candlelight vigil on the sidewalk in front of 610 Buchanan at 7 pm tonight?



At least this poster gave a nod to innocent-until-proven-guilty. Many didn’t. Here’s another from the morning of March 25:


It will be an unmitigated outrage if all of the students who refused to co-operate with the police (i.e., the wall of silence) are not expelled directly. Whether or not Duke takes a serious attitude about obstruction of an investigation of a crime of this magnitude will say volumes about the quality of Duke leadership.



The urge to protest in some way was palpable. Also from the morning of March 25:


By now, many of you have probably heard about the alleged rape in a house just off campus earlier this month. … [name redacted] asked me to let others know that she is organizing a silent protest at the men’s lacrosse game today at 1pm. All are welcome to participate. She is also leading a candlelight vigil in front of the house (610 N. Buchanan) at 7pm tonight. Again, any in the Duke community who are interested are welcome to attend.



And the conspiracy talk begins, mid-morning on March 25:


Why is Duke allowing the team to continue playing — to continue “business as usual?” Also, what’s behind them forfeiting the games – I wonder if the university wanted to avoid letting this issue get bigger, and called it off.



Next the privilege of Duke students is emphasized. The classism starts. This from an early riser (6 a.m.) on March 26:


It is an outrage that Duke’s only response to their stone-walling has been to defer to law enforcement. Will Duke’s recruiting motto be: “Send your Son and Daughter to Duke: Most of Our Students Haven’t Been Convicted Yet”? How can Duke tolerate a student body which includes students who have such an outrageously distorted sense of entitlement, irresponsibility, and narcissism that they flout the law? As a retired Duke faculty member, I ask where is the Duke administration and leadership on this? I say again, canceling games does not begin to address the problem.



In all this there was one voice of sanity, at 8 a.m. on March 26:


What is wrong with you? Your community has turned into a vigilante group!! Teachers, educators, ministers, parents so easy to convict without the complete story.

On this Sunday you would have stoned Christ of he were a part of the Duke Team. I’m personally ashamed of you!

Which brought this response an hour later from the retired Duke faculty member quoted above:

It is apparently alright with [name redacted] if the students refuse to co-operate with law enforcement and the investigation.



And yet more proof that there are sensible people in Trinity Park (afternoon of March 26:


I just want to point out that to date, no charges have been filed. Despite what so and so heard, or said, or did, the bottom line is that all of the facts are not in, people are innocent until proven guilty in our justice system, and we all have better things to do than to feak (sic) out over this before the facts are in.

I suggest we wait and see what facts come to light before we begin lynching any one with our words.



But this post is more indicative of the attitude that had already been cemented in the minds of the pot bangers (3:30, March 26):


Though the facts on exactly who committed the crime may not yet be known to us, the fact that the crime occured seems to be pretty irrefutable to me. A woman was brutally assaulted in our neighborhood. It doesn’t matter that we don’t know exactly who is guilty yet, we do know that SOMEBODY (several somebodies) ARE guilty.

It’s just a matter of time…

Still, some in Trinity Park cite Gottlieb as a dedicated officer. He prides himself on being a victim's advocate, often recounting stories from his years as a domestic violence investigator.

Dagenhart said she remembers seeing him at a vigil for domestic violence victims.

"This was not something he had to do as a part of his job," she said. "It's something he did as someone who cared. I know he cares about Durham. It's not just a job for him."

The media recipients were well known columnists and reporters of the News-Observer, Durham Herald-Sun, and local Radio/TV stations. It was a virtual who’s who of the Triangle media community. Coupled with what was alleged to have been said “off the record” it would have supported the false accusations and made it difficult for reporters to provide some opposite perspective to the PD’s campaign of misinformation. No reporter wanted to fight the tide by saying the accusations were baseless, especially when DA Nifong was going “off the record” spreading falsehoods about an exam report which he had never read."

Football players arrested

Four Duke football players and a rival North Carolina player were arrested in a weekend fray in downtown Chapel Hill.

All five men were arrested about 12:30 Sunday morning at the Chi Hi Club at 136 E. Rosemary St.

Two off-duty officers were working a private party at the club when a group of people started arguing, said Chapel Hill Police spokeswoman Jane Cousins.

The off-duty officers called for backup. When additional police arrived, they watched some of the football players exchange "angry words," Cousins said.

"People were squaring off as if to fight," she read from an officer's report.

A fight broke out. According to the report, Duke safety Chris Davis pushed a police officer in the chest during the scuffle, Cousins said.

Davis, a 20-year-old sophomore from Stone Mountain, Ga., was charged with assault on a government official and failure to disperse when officers were trying to clear the club, Cousins said.

Another officer said he watched Larry Edwards, a starting linebacker for UNC, punch an exit door, shattering the glass, Cousins said.

Edwards, a 20-year-old junior from Tampa, Fla., was charged with injury to real property and injury to personal property, both misdemeanors, according to court records.

Officers were trying to clear the club and ended up charging three more Duke players with failing to disperse. Those players were Michael Brown, a 19-year-old freshman linebacker from Houston; Segun Akande, 21, a junior fullback from Brooklyn, N.Y.; and Andreas Platt, 20, a freshman safety from Greensboro.

All five players are scheduled to appear in court March 13 on the misdemeanor charges, according to court records.

No additional charges are expected to be filed.

Duke coach Ted Roof said Tuesday, "We have a good group of kids, and they just made a mistake. That's not how I want my players to act."

Roof said he met with the players Sunday.

"They've been disciplined, and they will be disciplined further once the incident is resolved," he said.

Typically, Roof has suspended players one game for breaking team rules during the season. In 2005, he suspended reserve quarterback Gene Delle Donne and starting kicker Joe Surgan each for one game.

UNC coach John Bunting said in a statement, "We are aware of the situation. We will continue to monitor the situation and make any judgments about disciplinary matters when we are comfortable that we know all of the facts involved."

If Cousin Jackkie arranged the all-important N&O interview with Crystal, then what is the relationship between Cousin Jackkie and the N&O.

Cousin Jackkie is part of the LGBT community and an "entertainer". Just as there is a "Gay Mafia" with the New York Times, are area media particularly sensitive to the LGBT community? is there a relationship between the LGBT community and the N&O or other media in the area and therefore Cousin Jackki would be comfortable as a contact person?

I don't think the NandO/Crystal interview was set up by Cousin It. Gottlieb or more likely Nifong. The Fong was an elected official who needed ink to get re-elected. He knew the reporters and they would take his call and vice-versa.

Probably got a lot less of a sentence than Finnerty got for throwing a fake punch...

I realize the bit about Gottlieb having been transferred and/or demoted prior to the lacrosse party is both a meme and a claim in Ekstrand's case, but it's just plain incorrect. He for a while had been a patrol sergeant in charge of a 9 or 10 member squad in District 2, which covers north Durham including Trinity Park and the Duke East Campus. He was then made a sergeant of detectives in District 2 -- the same District 2 covering Trinity Park and the Duke East Campus. He wasn't moved out of the district. He wasn't even taken off matters affecting Duke, because Durham PD doesn't subdivide its districts -- they're its smallest operating units. And he quite clearly wasn't demoted -- in every police department I'm aware of, becoming a detective or supervising detectives is considered a step up from uniformed patrol.

For the district, see the map at http://www.durhampolice.com/districts/images/d2map.gif. The district boundaries haven't changed in many years and are as they were in March 2006.
