Mason, the people showing up for jury duty is a serious question as well as the intelligent and informed ability of persons entitled to vote. We saw this same group vote for "hope and change" despite the fact that most of the change was contrary to our Constitution. Never mind the Constitution they said. Obama promised more than he could deliver, but they have not forgotten the promise and are too ignorant to understand that he did not and can not deliver. The something for nothing society is alive and well and they fill the voting booths and sit in the jury boxes.

Wagstaff and Peterson knew Harvard Lawyer Dexter from Dexter heading a group to Elect Barack Obama President.

Why do I suspect that Dexter is going to turn Crystal on to more Social checks (as in money) and don't be surprised if behind the scenes contacts in the Public defenders office don't provide CGM with defense/representation in any Civil matter.

Mason, you are absolutely correct in your assessment of the largess that Crystal is entitled to. Threre is a lot of hand wrenching on this board about her "poor children" and yes it is true that her children deserve our concern and pity, but it is society that has created the culture whereby deadbeats like Crystal can bring innocents into the world and abuse and neglect them and so long as "big brother" is there to steal from one segment of the polpulation to give to another it's okay. I don't loose sleep over it frankly, but what I do loose sleep over is just how long this country can keep up the charade of the dependent class from whom there is no demand to contribute one iota to the rest of society. I am out of patience, I am out of cash, I am out of sympathy and I am through looking the other way and speaking great empathy into a computer screen when it doesn't come from my heart. So call me Grinch, I frankly don't care. I have lived by the rules, paid my bills, paid my taxes, obeyed the law, respected my fellow man and above all to the best of my ability have honored my God but I am now finished. The government has sucked me dry to pay for the miscreants roaming the streets like Crystal and her ilk and I have no more sympathy to offer.

Rant off

Great posts by 2close2durham and Truth Detector.

Unfotunately, Crystal Mangum has become the poster child for Durham. Segments of the Durham community will continue to do what they can to prop her up, as they persist in using her for ideological purposes. I predict eventually they will turn on her when she is no longer useful to them.

Is it true that she has been wholly abandoned by all the members of the Gang of 88 who are still at Duke? Cathy Davidson was not whispering there at the trial in support of her suffering sister.

These rules don't apply to these people. It's a courthouse run by incompetents for incompetents.

Note how virtually all of the national reporting on this follows the local reporting in
the N&O and HS;

and that therefore the public is NOT told that Crystal had to be carried out
by three or four officers; that she kept ducking the car; that she went "wild";
etc.

The impression one gets, if anything, is that she was calm and that police
restrained here; and that somehow there was spontaneous combustion
of a fire (which endangered no one and was no more than a barbecue)
which Crystal finally admitted to setting (perhaps in hopes of getting a lighter
sentence).

Once again the full story is never told.

(OTOH, a rather sedate, boring party at which some strippers attempted to perform
for four minutes--a performance which disgusted many of those present--
was turned by the media into a racist bacchanal--images which still are
repeated to this day.)

Such is the power of the media.

“The media's the most powerful entity on earth. They have the power to make the innocent guilty and to make the guilty innocent, and that's power. Because they control the minds of the masses.” (Malcolm X)

and I suggest that the local Durham media, rather than treasuring that power
as a responsibility, has instead vastly abused its role and become little better than
propaganda shills.

So much for the nobility of Journalism as a vocation...

Batherly is now posting on his site that one of the police personnel set the fire and framed Crystal.

The sheer depth of lies and deception that these people will stoop to in order to prop up Crystal is staggering.

What else the media neglected to do:

Ask for comments from:

Nifong

The gang of 88

William Barber

Joe Cheshire

Cy Gurney

Wade Smith

Jim Cooney

etc.

A good many people were involved with this woman and
these people would be the obvious first choices to go to for comments.

Instead, we get "the woman whom authorities said falsely accused...]

Point that out to the DA. It will help with the re-filing of charges.

I reread Blatherly and I overstated the issue. Blatherly makes an issue of the fact that the fire inspectors could not find a source of the fire, including a cigarette lighter which was not found at the scene, but which showed up in a picture of the scene.

To that he questions the conduct of police and leaves it open for interpretation as to whether or not they did it. He does not make a direct accusation which is how I understood it yesterday when I read the blog.

justice for Nifong, however, does make that statement:

"I am of the opinion that the police, most likely Officer Tyler, started the fire in the bathtub, not Crystal or her ex-boyfriend."

chatham,

Thank you.

Also, I say thanks to Judge Jones for reversing his earlier decision to link the three counts of “contributing to delinquency of a minor” to the 1st degree arson charge.

snip
Good post.

I'm a little lost as to what act or acts of delinquency any minor committed. I never read of them helping her light the clothes on fire, so that really had me wondering.

Maybe NC law is different than what we have in my state.
kbp,

NC uses the contributing to delinquency of a minor statute to implement portions of the Federal Child Abuse Prevention and Treatment Act (CAPTA). The law holds parents accountable for any act or failure to act which presents an imminent risk of serious harm to the child. (See below)

Quote:

Child abuse and neglect are defined by Federal and State laws. The Federal Child Abuse Prevention and Treatment Act (CAPTA) provides minimum standards that States must incorporate in their statutory definitions of child abuse and neglect. The CAPTA definition of "child abuse and neglect," at a minimum, refers to:

"Any recent act or failure to act on the part of a parent or caretaker, which results in death, serious physical or emotional harm, sexual abuse, or exploitation, or an act or failure to act which presents an imminent risk of serious harm. [1]

<snip>

Physical Abuse

Physical abuse is generally defined as "any nonaccidental physical injury to the child" and can include striking, kicking, burning, or biting the child, or any action that results in a physical impairment of the child. In approximately 38 States and American Samoa, Guam, the Northern Mariana Islands, Puerto Rico, and the Virgin Islands, the definition of abuse also includes acts or circumstances that threaten the child with harm or create a substantial risk of harm to the child's health or welfare. [5]

-------
1. 42 U.S.C.A. § 5106g(2) (2003)

5. The word approximately is used to stress the fact that the States frequently amend their laws. This information is current through July 2009. The States are Alabama, Alaska, Arkansas, California, Colorado, Florida, Hawaii, Illinois, Indiana, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Montana, Nebraska, Nevada, New Jersey, New Mexico, New York, North Carolina, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, Tennessee, Texas, Utah, Vermont, Virginia, West Virginia, Wisconsin, and Wyoming.

http://www.childwelfare.gov/systemwide/laws_policies/statutes/define.cfm

CAPTA is a law I am somewhat familiar with. How NC uses the phrase “contributing to delinquency of a minor” is the confusing part for me.

I'm not aware that a "minor" acted in any way that would indicate "delinquency" on their part, so "contributing" to it seems impossible.

It's just the wording of it that throws me off.
