Evidently Matt Milliken had problems with twitter ... his final couple of tweets:

- Sorry about Twitter silence. Multiple efforts to tweet on multiple platforms failed.

- A mistrial on arson was declared. Mangum was found guilty on all five misdemeanors. She was sentenced to time served on them.

- Meanwhile, Mangum is freed from pretrial incarceration, and all bars to contact with and custody of her children were lifted by the judge.

- For stories about the Mangum trial result and the Wagstaff contempt hearing, please see The Herald-Sun’s Saturday edition!

- Wait, one more thing! The prosecution will decide in early January whether to retry or drop Mangum’s arson charge. Good night!

Thanks to Matt & THS for his live reporting!
He did do a good job of reporting. I emailed him and thanked him.

Well it made Drudge! ...and the Washington Post

The Durham Miscreants Game is up.

Now if Judge Beaty starts ruling we can proceed to discovery and that is when the fireworks start.

imo, there is no way the prosecution will retry the arson charge.

The jury, at least 9 of them, 1) thought the PD & Prosecution over charged Mangum & 2) ignored the letter of the law. It was clear they were hung on "malicious" and "intent" and the judge allowed the prosectuion to clarify the definitions several times -- to no avail. Hindsight is 20/20 but justice would have been better served by allowing for a lesser included charge on the arson.

With respect to the children -- I'm surprised (shocked?) at Jones comments/ruling, saddened and worried. What a life.

edited to correct my confusing double negative !

Jmoo, you are my hero forever...and I agree... I do not see Second Chair Cline re-trying this case.

I believe Ms. Cline to understand the political climate wherein she lives. She must live and "operate" within the Durham's ruling clique. She must stand for re-election. Like Nifong, she will need the Black vote. She will need the Progressive vote. Re-trying Mangum is counter productive to her political well being.

I also believe Ms. Cline knows and understands the Law. She stood beside a rogue D.A. as he rigged line-ups, flipped Kim a sweet deal to change her story, suppressed exculpatory evidence and...put a witness on trial for speaking truth to his "power." Cline was at Nifong's elbow as each of these affronts to justice occurred. Can anyone link to her outcry? She was a silent accomplice to the Frame. I cannot believe that if ordinary citizens like us could see these outrages...an experienced ADA could NOT.

Whatever "thorns that in her bosom lodge" that allowed her to condone Nifongs actions with her silence and cooperation, were rewarded by a Durham electorate who gave her his job.

She will NOT turn her back on them. No way. Not ever.

Durham's cronies continue to "moon the system".

As others have noted, both cream AND pond scum rise, and soon enough Mangum will be in trouble again.

Like all of you, I am just saddened by all of this. And I am becoming exhausted.

(But I am always so extremely proud of our gifted hooligans and the positive effects that have been accomplished through our efforts here. Your examples of heroic action have served as important lessons for me)

Durham's cronies continue to "moon the system".
.
If you recall, Judge Orlando Hudson approached Nifong and told him that convicting and sending black people off to Jail wasn't the answer. Nifong supposedly agreed.

So, there is a history in that courthouse of Judges dictating to the DA's office in terms of what they should and shouldn't prosecute, and how they should go about it.

I'm willing to bet that Judge Jones made his opinion known to that office to not bring further charges (or these charges) against the Petite, Shy, shining example of Motherhood and everything Good.

Interesting reading on Jones. He may be in Crystal's cellphone for all we know.

Before sentencing, Jones cautioned Mangum against being quick to anger and said it was important to obey the police.

Jones suggested he would order mental health assessment and treatment, if necessary, but did not do so.

The judge, apparently misinterpreting state sentencing laws, tried to sentence Mangum to at least three consecutive jail sentences of 45 days. He reversed course after Dexter and McCullough requested a sidebar.

Jones then handed down sentences of 45 and 43 days, two days shy of the maximum. Since Mangum had been confined 88 days before trial, she was freed.

The only leverage Jones had -- two days' incarceration -- gave Mangum little incentive to get psychological assessment.

Judge Jones seems to struggle a little bit at times, to say the least.

The Judge said in court that Crystal had been punished enough.

He was just confused. There were never any plans to send her away for a day.

Maybe her previous conviction for trying to run over a Cop should've give Judge Jonesey a clue that he could've sentenced her much longer for another charge of fighting/resisting Police.

That was never in the cards though.

Joan's analysis of Cline is spot on. I have lately been doing some reading on prewar Germany, Austria and France under the Nazis. One sees the same thing over and over. People refusing to stand up to the evils around them - thinking that they will go away or that the evil that exists is "not that bad" compared to what it might be. We all have a responsibility to stand up for what is right.....the existence of this board is testimony to that. RCD, their families, and their lawyers recognized that if they did not fight with everything at their disposal, an evil not only would be done to RCD but to others as well in the coming years.

I realize that there are many who wish the hoax to die a quick death - to forget about what happened. Until justice is done - and it is not just that RCD be made whole in terms of their reputations, it is also that Mangum, Nifong, Brodhead, Steele, Burness, Wausiolek, etc. all be made accountable in a court of law and financially to boot (it is always money that really talks and greases the skids) - those who care about justice and what is right must persevere with all that resources that they have. Yes, it is exhausting - I am sure that others like myself went to bed exhausted and depressed by yesterday's proceedings. But persevere we must. Additionally, so that there will not be other Mangums out there, Crystal's children need to be placed somewhere so that they can have a chance at a decent life. As of now, the lessons that they are imbibing at the knees "of the only parent that they know" is that a life of crime is the ticket to success, that drugs and alcohol are fine to use and abuse, and that "rich whitey" has it in for them.

Abe Jones being the judge is ... noteworthy. Guy's a bit of a loose cannon.

.
They need to move this guy to family court. They'll be no backlog as he can just look at people as they walk in and Identify the Good Mothers and Good Fathers - why waste the time of these fine upstanding citizens in court.

He needs a TV show.

You know something is wrong when your name is Abe, and
no one calls you Honest Abe.

There's the first sign of trouble right there.
