I missed all the shenanigans this afternoon and just went through 20+ web pages. A few thoughts: GOOD NEWS 1) Crystal was found guilty of 5 misdemeanors to add to her rap sheet. 2) Because they involve contributing to the delinquency of juveniles (her children), we can hope that social services will stay involved. 3) 9 out of 12 jurors were ready to convict her of felony arson 4) Crystal's behavior as a mentally ill, prescription drug abusing grifter was again on display, countering the metanarrative of her as a victim 5) The tweeting by a reporter for the Herald-Sun (!) was useful and well-done, allowing us immediate access to courtroom developments. 6) Jackie Wagstaff's contempt conviction finally shut up the loud-mouthed (insert your favorite word here). 7) Because it was a mistrial there is a chance (unlikely) she could be recharged with a felony BAD NEWS 1) Crystal was not convicted of the most serious charge of felony arson-- a mistrial being the unsatisfying result. 2) She will not get further time in prison to ponder the error of her ways. 3) She beats a felony on her rap sheet (for now). 4) She is back on the street where she will, inevitably, create mischief when she "freaks out" again. 5) Victoria P and Steve Matherly did not get the contempt citations they also richly deserved. Post Verdict Analysis Jury trials are won and lost on the instructions. Mani Dexter did a great job of muddying the waters on the so called fifth element of malice in the First Degree Arson charge. That allowed her to essentially argue for jury nullification without drawing a contempt charge from the Judge. Well done, to her. The state's trial tactics were strong throughout. ADA McCullough perfectly played Crystal's lawyer until the instructions conference. There, he was trapped by Dexter into allowing just enough confusion into the instructions for her to win. Someone in the DA's office overcharged the case. The state should have easily won if Crystal had been charged with Arson in violation of NCGS § 14‑66 rather than First Degree Arson. McCullough's mistake was not arguing for conviction on the lesser included offense under § 14‑66. It's still a felony and would have given the judge a way to sentence Crystal to a term of probation even if he wasn't inclined to give her more jail time. The sentence, 88 days in jail was substantial for this type of arson. Remember Lisa "Left Eye" Lopes only got five (5) days in jail for burning Andre Rison's shoes and mansion. Coverage. Skeptical: In all things it is wise to look at the good and the bad. Thank you for laying out the salient points. While three on the jury seemed unable to understand the evidence or the law, the fact is that nine did. This in and of itself would have to give Crystal pause. Her act is wearing thin....fewer are out there who are willing to buy the story that her enablers have convinced her is bankable. Sooner or later, she will be arrested again - one can only hope that others will not be harmed by her activities. Edited by cks, Dec 17 2010, 08:07 PM.

Two technicians later and still no heat. The day began with my furnace working - a tech was scheduled for routine maintenance. He cleaned everything and changed the filter - and that is when my problems began. Sometimes I ruly believe it is best to leave well enough alone. The third tech has been here now for over an hour and the temp has only risen two degrees. I fear it is going to be a long cold night. |

Tell him to check the line. Remember I had the same problem this week. 2 differant repairmen -and it was down to 56 in my house. Finally, he found the line had ice in it. It was frozen solid. |
