Certainly Wagstaff will appeal her conviction but in the meantime I hope that she enjoys life in the lock-up. Could it be that there are some within the Durham justice system tha have finally decided that they are sick and tired of the Crystal and her enablers show. FRankly, I think that the judge should have the jurors stay the evening. It is so bizarre that a deliberating jury could be allowed to go out on the town for lunch. WHy not bring in sandiches and hot coffee?

Jackie Wagstaff sent to jail for contempt at Mangum trial
The Herald Sun
12.17.10 - 05:05 pm
Jackie Wagstaff has been sentenced by Superior Court Judge Abe Jones to 10 days in jail and a $200 fine for contempt of court. Wagstaff audibly whispered "this is ridiculous" from the front row of the gallery while Jones was addressing the jury in the Crystal Mangum criminal trial. Wagstaff was removed from the courtroom immediately after Jones issued his sentence.

Jones sternly warned other spectators that if the bailiffs inform him of disorderly behavior, he would sentence them as he had Wagstaff.

Wagstaff, a supporter of Mangum, had attended most of her trial over the past few weeks on charges involving felony first-degree arson and five misdemeanors.

Did we establish that the misdemeanor verdicts were guilty?

I wonder if the Herald Sun will have the gumption to describe what went on in the courtroom
with Mangum's supporters.

(Somehow I doubt it...)

Judge declares mistrial on Mangum's felony arson charge

DURHAM Superior Court Judge Abe Jones has declared a mistrial on the felony arson charge in the Crystal Mangum trial. The jury was split 9-3.

The jury was unanimous regarding the misdemeanor charges. Mangum was found guilty on three counts of child abuse, one for injury to personal property and one for resisting arrest.

During today's proceedings, former Durham city councilwoman and school board member Jackie Wagstaff was jailed for ten days for contempt of court in the Crystal Mangum arson trial.

She was charged with contempt after saying "This is ridiculous" while the judge was ordering the jury back into deliberation after two days of being split on Mangum's felony arson charge. Jones also ordered her to pay a $200 fine.

Jones heard the comment directly but didn't know who said it, and threatened 30 days of jail time for anyone making any further outbursts.

But bailiff Staci Ottoway identified Wagstaff as the person. Jones then called Ottoway to testify to that under oath and called for public defender Lawrence Campbell, whose office is across the hall from the courtroom, to represent Wagstaff before the judge took any action against her.

Campbell then called Wagstaff to the witness stand. Wagstaff apologized to the judge and said she made the comment as part of an ongoing conversation with fellow Mangum supporter Victoria Peterson.

"It was just a sidebar," Wagstaff said. "It wasn't intended to disrespect your authority."

But Jones then called another bailiff, Scott Hodges, to the stand. Hodges testified that he has had to quiet Wagstaff two to three times a day over the course of the trial.

Jones said that Wagstaff's explanation "strains my credulity."

Both Hodges and Ottoway noted that Wagstaff and a handful of other Mangum supporters have been making audible comments throughout the trial.

Jones also warned a few other supporters to stop the audible comments bailiffs have reported.

I'm sorry VP is not with her. This courtroom has more rings than Barnam & Bailey

The prosecutor should next time, if there is a next time, bring in an expert to tell the jury exactly what arson is.

This has to be one of the absolute dumbest 12 people to ever sit on a jury outside of south L.A.
