Jones: “That's really all I can say to you. I don't think I should say anything else." Two jurors stand, thinking he's dismissed them.

Jones nods. “All right. — I’m going to ask you to try again if you will.”

Jones: Have the three always been on the same side? Forewoman: “No, they haven’t.” “They shifted around?” Forewoman agrees.

The vote is 9-3. Jury note: [bold]Nay voters are not willing to change. [/b]Jones is addressing the panel.

I missed a short bit while stepping out for a bathroom break. The jury is still stuck. Dexter moves for mistrial.

Until this statement, I was not sure which way the 8/4 split went. How did we get to 9/3? Have they deliberated since they returned from lunch? Milliken says 3 nays -- do you think that means 9 'guilty' and 3 'not'??

Someone asked why court personnel would be reading the blog -- it wasn't court personnel. I suspect it was Matherly who ultimately got word to Crystal's atty who then talked to the judge.... The j4n author then told me 'we monitor the blog' ....
.
They are reading right here.

If the bathtub is cast iron it's a fairly safe place for a small fire in a building. If the tub is plastic or fiberglass, it's a very bad place to start any sort of a fire, as it will burn merrily.

It's hard to believe the tub is iron.

3 loads of clothes will not be a small fire in any case...

Thanks for the reporting!

Wagstaff and Matherly sit in the front row with another woman - and they mug and put on affectations the entire time.

Observers thought the Judge had seen them doing it a week ago, it would be almost impossible not to see the exaggerated head shaking and nodding. We were told in writing - Matherly would look down slightly as he laughed. Sometimes covering his mouth like he was trying to restrain laughter. We were told he was doing this while the Police officer testifed and answered questions from the short-haired Defense lawyer.
