CRYSTAL MANGUM TRIAL; December 2010

As far as crystals pain is concerned. During the playing of the video and the interview by investigator bond, there was no complaints or actions by crystal that indicated to anyone that she was in any pain. The beginning of the video while crystal was by herself for 40 or so minutes, there was no indication that she was in any pain, soreness, limping or moans. She was quiet for most of the time that was shown, but she also walked around a little bit. The indication of pain came after investigator Bond was done with the interview and Bond left the room. After a few minutes of seeing crystal still sitting down with her head on her arms on the table she did start yelling ow ow ow and saying she needed help for back pain. This was the first indication 0of any problem that crystal had with any pains, aches or anything related to her back. She never complained about any pain from the injuries she had received by Milton to the face. The guard who was in the room with her, or came into the room because he heard her, (we could not see the guard right away on the video when crystal starting saying owww) said he would get medics there to look at her and she should sit down and stay quiet. That is all of the tape we saw. The part about crystal on the floor rolling around was verbally presented by investigator bond to the jury. The jury never saw that part of the tape. The defense requested it to be shown but the judge denied that.

This sounds like more than a "fishing expedition" to me. It sounds like inside knowledge.

Whatever it was. It was denied.
I wonder if the judge had granted the request and upon review the officers records were excellent then what? This would have been a very risky move on the part of the defense. We do know from the lax case and from the so-called drug bust in Trinity Park in 2008 that warrants are not always the MO of the Durham police.

Near the end of the trial the defense tried to get "Officer" Tyler's personnel records admitted into evidence. This guy has been in trouble before and very recently with complaints lodged against him. The DPD lawyer was able to keep the records out but it was clear that there was something in them that would not have looked very good if they had been brought out into the open. I suspect that we will be hearing more about this guy as those allegations are dealt with. Remember that name: "Officer Tyler", you'll no doubt be reading more about his exploits in the future.

Prosecutor believes the question has to do with the jury instructions and argues that they can instruct on law at this point but cannot rewrite the jury instuctions.

Arguing whether Crystal communicated a threat. Prosecution says irrelevant -- she was not charged with communicating a threat.

Wow -- on the surface, it's a little scary that they're asking the Judge that ... not good ...

Are they questioning whether she should have even be arrested in the first place? Wow ...
