Crystal Mangum trial: Day 5 (closing arguments
)
Submitted by jessedeconto on 12/15/2010 - 19:09

Crystal Mangum could face up to seven years in prison as a jury decides whether she set her own apartment on fire.

(snip)

Dexter blamed police for most of the charges, saying the walls and ceiling of Mangum’s bathroom never would have charred if officers hadn’t kept her from tending to the fire.

She compared the fire to the accidental spreading of flames from an overturned candle or a barbecue grill brought into a house without heat.

“We call these accidents and we say it’s so sad … but we don’t call them arson,” Dexter said. “The fire was set within the bathtub, which may be the safest place within that apartment that you could set a fire.”

(snip)

Even if Mangum didn’t mean to set the building on fire, McCullough argued, she’s still responsible for the natural consequences of her actions.

It's difficult to guess how this jury will go. Too much wiggle room for the jury, in my opinion.

On the other hand, with defense counsel like this "the walls and ceiling of Mangum’s bathroom never would have charred if officers hadn’t kept her from tending to the fire", Crystal must go to jail...

for the children's sake, what right-minded person sets clothes on fire to be a "tended fire"?

I hope I don't offend anyone but......

We are on jury watch as of tomorrow-weather permitting.

We need help in our watch.

Come ye from yonder ways :) and give us some of your time. We need to hear this verdict from the jury's mouth to our ears and then to LS board. WE need to see for ourselves, the reaction in the court room. We need laptops in the court room.

You need not speak to anyone out of fear you may be identified with your screen name. imo-we are way passed being scared of who someone really is. re: screen name
For those who have hung in there with us ( especially for the last two years) there should be some level of trust by now. Don't you think?

We don't need to know who you are if that is your wish. We just need to know someone that posts on this board will be inside all day.

Say a prayer for the kids tonight, after all they are the ones who need a chance at life.

Tomorrow morning jmoo.

The news just said, our schools are on a 2hr. delay tomorrow. That could change if the weather get worse.

I missed most of the action today at work, but did check in occasionally. I did see that there were up to 23 people watching on-line at times, including some old friends. I also would like to thank our intrepid Blog Hooligan reporters including J, Chatham, Walt-in-Durham and others.

The last line of the N&O blog report by Jesse James DeConto caught my attention-- it deals with the key concept of intent:

Could any of our legal experts comment on this interpretation. and whether it is valid?

You all are welcome.

If the jury is as anxious to get on with there shopping/ cooking/baking as I am ( I believe they are) we should have a verdict tomorrow.

CMas Tree <<<<<<<<<<<<<<< needs to do mine.

:smilfacak: <<<<<<<<<<<<<< needs to do also.

I don't think so. Go back and read chatham's notes. He said something about 8:30. Maybe that means in the morning.

I was wondering the same thing.

Does conviction on arson require intent? (The ADA said intent was the 5th element.
She clearly intended to burn the clothes. Did she "intend" to burn the dwelling?
She did close the door. I bet the jury asks for clarification on this.)

Couldn't she have been charged with child endangerment?

If I understood the Judge correctly, Mangum was charged with child abuse
and the Judge will only rule child abuse if the jury convicts on the arson charge.

I don't agree with that at all.

Great reporting!

I'm surprised they were able to finish up today but it sure will be interesting to hear how the jury decides.
