BTW- arguments are expected to last 30 min.for each side.

The jury could get the case by 3 ish.

As tired as this jury is.....we may hear today what they think

Also.......one juror was dismissed.

The defense rested without putting Crystal on the stand. The state boxed her in, and she wasn't willing to risk testifying. No doubt the Crystal supporters will claim that once again she has not been able to tell her side of the story. But, the truth is she's had multiple opportunities to tell her story and she has either told different stories, stories that don't make sense, or outright prevarications.

Jury trials are won and lost on the instructions. Today, Judge Jones heard arguments about how to instruct the jury. He is mostly sticking to the pattern jury instructions much to Crystal's dismay. However, the state lost on the most important point, Mani all but told the court she was going to argue for jury nullification. Beyond warning her not to do it, Judge Jones is going to give her wide latitude in how she makes her closing argument, just so long as she does argue facts that are in evidence. Nullification is Crystal's last hope because the state has sufficient evidence in the record to convict on First Degree Arson, Child Abuse and Neglect (three charges) and Resisting Arrest. He denied the motion for a directed verdict and seemed a bit miffed that Crystal even raised the issue.

An observation from the trial. Crystal and her supporters have been trying to claim that somehow she was in great pain in February from some sort of lingering back injury. I have seen her twice in person since the hoax began. I have seen her videos as well. In both personal observations, she was not limping and exhibited no limits to her range of motion. If she has a back injury, it's not limiting. Normally, when a person has a lingering back injury it obviously manifests in some limits to the range of motion or a limp. One of the alternate jurors has a limp. I'm thinking her claims to be in pain are largely for the purpose of obtaining prescription pharmaceuticals rather than legitimate treatment.

I cannot be in court this afternoon for closing arguments. I hope another hooligan can.

I can't imagine that Tracey Cline's office wanted to see her testifying on the stand;
or that the defense wanted her on the stand.

DURHAM -- The defense rested this morning after calling its second witness in Crystal Mangum's arson case.

A family friend, Peggy Kirkpatrick, testified she had told Mangum's son to call 911 because she thought Mangum was in danger during a fight with her boyfriend, Milton Walker.

Superior Court Judge Abe Jones did not allow Mangum's attorney Mani Dexter to introduce medical records to show that Mangum may have been medicated during the altercation, her arrest and interrogation. Jones also denied Dexter a subpoena for a Durham police officer's personnel file she said would have shown a pattern of improperly entering resident's homes.

Jones had already ruled that the officers needed to go inside to make sure Mangum, her children and Walker were safe.

I can imagine that if the lacrosse case had come to trial, a crony judge (Stephens, Titus, Hudson-even Smith)
would be ruling against permitting any of Gottlieb's actions against Duke students to be entered into evidence.

Not only would a jury have been subjected to enormous pressure to convict; but in addition the entire
process itself would (IMHO) have been hopelessly biased.

Nifong knew he had nothing to fear if he brought the case to court--nobody in the media was going
to challenge him, and (almost) nobody in the law was going to challenge him.

No sane attorney would put her on the stand, but I am sure her supporters will be saying she didn't get to tell her side of the story for years to come. I doubt she knows reality or is just a lifelong con artist.

The special prosecutors met with the accusing witness a number of times and questioned her about inconsistencies that existed at the time the Attorney General’s office accepted the case, as well as other inconsistencies that had arisen since then. This was apparently the first time these questions of inconsistencies had been asked formally.

In meetings with the special prosecutors, the accusing witness, when recounting the events of that night, changed her story on so many important issues as to give the impression that she was improvising as the interviews progressed, even when she was faced with irrefutable evidence that what she was saying was not credible. The accusing witness attempted to avoid the contradictions by changing her story, contradicting previous stories or alleging the evidence had been fabricated...snipped

My guess would be today -if- the jury is as tired and discussed as they look.

The one time I really need to be there and I am stuck at home.

Slightly off topic but pertinent to Crystal the following story out of New Yor

(Dec. 15) -- Heidi Jones, a weather anchor for ABC's New York City affiliate and an occasional forecaster on "Good Morning America," was suspended today after being arrested for allegedly lying to police about being sexually assaulted.

The WABC-TV weather anchor told police last month that a Hispanic man tried to rape her while she was jogging in Central Park on Sept. 24. But Jones has since admitted making the whole thing up, police told AOL News today. WABC-TV announced the suspension today during a noon broadcast.

The New York Post said the claims of assault became hazy when investigators found inconsistencies in her story and could find no witnesses or suspects. They said officers also questioned why Jones had waited two months before reporting the attempted rape. According to the Post, Jones may have spun the tale as a "plea for sympathy" because of trouble in her personal life.

Police said Jones also claimed that the same person who assaulted her in the park later harassed her over the phone. Jones, 37, was arrested Monday and charged with two counts of filing a false police report, police said. A conviction could bring a year in jail or a $1,000 fine.

On the day of the arrest, postings on Jones' Facebook page gave no indication that anything was amiss. "You guys ready for the arctic chill? Ready or not...it's going to be bitterly cold tomorrow and wednesday with highs sub freezing and a wind chill to make your toes shake! Be careful!" she posted.

Jones could not be located for comment. Her attorney, Paul Callahan, said the accusations were still unproven. "Ms. Jones has had a distinguished career as a broadcast journalist and urges all concerned to refrain from jumping to conclusions about the unproven charges against her being discussed in the press," he told the New York Daily News in a statement.

Didn't the media tell us women didn't lie about rape?

I have been stuck here all day waiting for repairman to fix my heat. Its 58 degrees inside.
