Some rape claims are actually false (despite what the media would have us believe). Some of these false claims are made for retribution, intimidation, or vengeance. If the names of accused persons are as protected as the names of accusers, then some of the motives for false accusations disappear. Further, the stigma of having been falsely accused also disappears. Imagine if the media had only been able to report that ______, an exotic dancer, claimed to have been raped while performing at a party--a possible cautionary tale for other dancers (no further information provided). What would have followed would have been much less than an opportunity for activists to use those false claims to push their own agendas. And without the names and the association with Duke and the personal details of the accused, Nifong would have had no benefit in pursuing the prosecution. None of the "conclusions" about the nature of the crime need to have been ruminated upon until it was actually determined in a court that there had been such a crime. No Gang of 88--till after convictions. No candlelight vigils--until after convictions. No committees to study changes--until after convictions. And no stigmas if there is not a case, the charges are false, and there are no convictions. The way it ought to be... |
