T+30 Months


We're a little past 30 months into the Nifong Hoax, and it is still not over. I do not mean to say that as a, "It's still not over?" but rather a declarative - it is still not over. In some ways, it never will be - no one has successfully answered Ray Donovan's post-acquittal question, "Which office do I go to to get my reputation back?"

And that applies to the three men indicted in the lacrosse case, regardless of the extraordinary move on the part of the state's attorney general in declaring them not only not guilty, but actually innocent.

It applies to the man whose private e-mail to teammates became a public and decontextualized bludgeon against their character.

It applies to the man who had to sue to correct his academic record.

It applies to the men whose faces were turned into a "wanted" mosaic and hung throughout campus.


We are now an additional 18 months after that. Those presiding over the judicial processes in the suits could, if they so wished,
help bring about a better form of closure.

They could help in the restoration of reputations.

They could help insure that 40+ individuals don't have to carry a stigma with them for the rest of their lives (by fulling exposing how fully they were made the targets of a hoax).

They could help find the answers to a lot of questions.

Of course, perhaps that is not considered a primary goal. Perhaps "justice" in this case is not supposed to mean justice. Perhaps it is supposed to mean, "moving on", and "induced forgetfulness", and "never mind".

Maybe those are considered by some to be more important goals.

Maybe.

But the result is, it's still not over.

Why continue to wait it out?

Because the opposition has only one hope--that everyone will tire of the wait.

Anything that tends to keep this case alive - in the courts, in the public eye, wherever - is good. And the reasons for this extend far beyond the Duke case itself, the kids that have been victimized in this case, etc. As Joan has observed somewhere, the Duke case is NOT an anomaly. It is the standard mode of operation for many ...

The colorful collapse of The Frame has had an effect. If a Nifong tried something this ridiculous now, I suspect he would not get the necessary level of cooperation, even from a Brodhead.

What happened at Duke was undoubtedly the worst example and they have the strongest case, the best chance of making a difference. I'm very grateful they have the strength and will to continue the fight.

What's left? The criminal justice system is a mess in this country--not just in Durham. Every victory won in the Duke case makes it easier to achieve reform in other places. The "courthouse crowd" is everywhere--and it's more than past time that some sunshine disinfectant was liberally applied.

Academia--what a cess pool. Incompetant, bigoted hacks who are utterly unable to function successfully in the real world--are all about the power in academia. How many of the G88 are still in their tenured positions--poisoning the minds of young people?

Civil suits are boring--and glacial in their pace. Yes, the powers that be and the G88 and their ilk want us to loose interest and move on.

I wish for that day when the treachery and deceit of this case is opened for all to see. I may be part of the Don Quixote Windmill Club but I know it is a worthy cause. As long as this dirty episode is being hidden I will continue to charge the windmills of Durham. They are not imaginary

Of all the people Brodhead has tried to destroy, the least likely one, it seems to me, is Pressler, about whom NOBODY in his right mind ever had anything negative to say, not even Sue, who ought to know. Brodhead is downright scary when he descends into his fantasy "Pressler-is-the-opposite-of-a-Mensch" story
