Would Elizabeth Edwards sue; alienation of affection

Elizabeth Edwards is threatening to sue the man she believes helped destroy her marriage.

However, many wonder if she has a solid case against Andrew Young, her husband's former aide during the presidential election.

North Carolina is one of seven states where a person can file a lawsuit against someone they believe destroyed their marriage.

John and Elizabeth Edwards are now separated after 30 years of marriage.

Andrew Young revealed his latest potential legal battle outside the courthouse in Hillsborough Wednesday following a hearing over John Edwards and his mistress Rielle Hunter's sex tape.

"Elizabeth has threatened me with an alienation of affection lawsuit," Young said.

But it may not be much of a worry according to Raleigh divorce lawyer Lee Rosen.

"A claim against Andrew feels like a scorned woman, acting out on that emotion," he said. "Elizabeth would need to show that she and John had a good marriage, there was love and affection there - which might be difficult - then she would have to show this gentleman came along and maliciously damaged and destroyed that love and affection and contributed in some way to the end of the marriage."

In his book "The Politician" Andrew Young writes that he agreed to cover-up the affair between John Edwards and Rielle Hunter, because Edwards convinced him it would help Edwards get elected.

"You have to remember, John Edwards was one of the most persuasive trial lawyers ever and this is not like having a pitch by a normal person," Young said.

Young has told ABC11 Eyewitness News that Edwards fired people who worked on the campaign if they suggested Edwards should end the affair.

Hunter worked for Edwards 2008 presidential campaign as a videographer.

Rosen says he thinks Andrew Young may have actually been trying to preserve John and Elizabeth Edwards' marriage by hiding the affair. He also says he thinks Elizabeth Edwards is targeting the wrong person in threatening an alienation of affection lawsuit.

"Rielle is the bad guy here, she should not have done what she did, and John is the bad guy," Rosen said.

Rosen also says it can take years to deal with one of these lawsuits - time Elizabeth Edwards may not have, because of her battle with cancer.

Elizabeth Edwards has also reportedly said she will drop the threat of a lawsuit if Young donates $250,000 to the Wade Edwards Foundation - a nonprofit group named for the Edwards' late son who died in a car accident in 1996.

Meanwhile, a spokeswoman for John Edwards denies he's popped the question to Hunter.

"The National Enquirer" reports Edwards proposed to Hunter on the day he publicly admitted fathering a child with her. But Edwards' spokesperson called the Enquirer story absolutely untrue.

If EE said that she would drop a lawsuit if Young contributes to the Wade Edwards Foundation is simply exhortation by any definition that I know. If EE is attempting this, it will backfire and could cause her legal difficulty as well. EE did threaten to sue the wrong person, but the law is archaic and will not hold up in court. The woman is crazy, as is all the players in this soap opera. Proving an emotion is very difficult.

It would seem that the person EE should be suing is "Camera Girl". After all, it wasn't Andrew Young with whom the Breck Boy had an affair - it was that New Age bad girl, Rielle Hunter. My bet is that EE's threats are just that and nothing more - she would not want to have in open court people called to testify that would and could refute the public persona that she has so carefully crafted about herself.

The problem with the Edwards, both St. E. and Two America, is that they are narcissistic poseurs who think that the rest of the world should be thankful to be allowed in their orbit and to serve them unconditionally. One can see the former in Breck Boy's repeated confidence to people about his bizarre behavior in the morgue with the body of his dead son (he was always repeated the same mantra that he was going to tell them something that he had never told anyone else) and the latter in that they expected those who worked for them to serve at their beck and call and those that fell out of favor with EE were dismissed. One of the points made in Young's book is that the Obama campaign was populated with castoffs from the first Edwards campaign - chief among them David Axlerod.

The Lifetime network made a movie about that NC law and the scorned wife got about 2 million dollars. I believe it was a true story. It was called "The Price of a Broken Heart"

Did anyone hear the recorded messages EE made to Young's wife. I doubt that EE wants some of her messages played in court. Several were played on Hannity last night with the promise that there are more. This may be an effort to make EE think twice about opening up more cans of worms.

I heard them. Leaving cryptic messages on voice mail is just plain creepy. If she had a gripe with the woman she should have called her and left a message to call back . . . and let it rip. I'm beginning to have NO sympathy for anyone involved in this drama. (except for the child, born into another dysfunctional family)

"Alienation of affection" presumes that there was actually, at some time, genuine affection. How does the court prove that two narcisstic people even HAVE the capacity for affection? I just see John and EE as two people who used each other for their own goals. When the symbiotic pathological relationship ceased to meet the selfish needs of one or both, the unhealthy glue that held it together gave way. There might even have been affairs on EE's side if she were not so shrewish and unappealing.

I'm am actually weary of the voyeruism that pervades the whole affair. Except for the question as to whether any laws were broken when JE supposedly sent campaign fund to RH, I think it is time to move on and let these poor sick people live their lives. There are more important issues at stake in America today.
