Where are we in the suits?

Am I correct in assuming that the Carrington and Evans suits are awaiting a decision on whether they can add one additional count to their complaints (and complete some minor housekeeping details);

and that the McFadyen suit is awaiting a decision on the motion to dismiss? (and has been so waiting since July?)

I think you pretty accurate Quasi.

The response by Evans was on Sept 21. We should be hearing something soon on that issue.

Jury To Weigh Reichhold Coverage For Resin Suits

Law360, New York (October 01, 2009) -- A federal judge has opted to let a jury decide whether polymer maker Reichhold Inc. is entitled to coverage from National Union Fire Insurance Co. of Pittsburgh and other insurers for litigation costs associated with the sale of allegedly defective window resin intended to help buildings withstand hurricane-force winds.

DURHAM - A federal court judge will have to sort out a dispute between Reichhold Inc. and one of its insurance providers over how much the insurer should pay to settle a lawsuit against the Durham chemical company.

A complaint, which was filed by National Union Fire Insurance Co. of Pittsburgh, Pa., has been working its way through the United States District Court for the Middle District of North Carolina since October 2006. National Union seeks a judge's ruling that it does not have to compensate Reichhold for damages resulting from two lawsuits.

National Union is an affiliated company of American International Group, or AIG. Michael Arcaro, a spokesman for AIG, was similarly tightlipped. "Our policy is not to comment on ongoing litigation," says Arcaro.

The two underlying lawsuits in question trace their origins to litigation between Reichhold and Pompano Beach, Fla.-based Nebula Glass International, which does business as Glasslam.
