Justice Department backing Obama in birth certificate case, how can this happen? The Justice Department is urging a federal court to toss out a lawsuit in which prominent attorney Orly Taitz, who is representing Ambassador Alan Keyes and 200 military members, is challenging Obama's Constitutional qualifications to be president. In a motion filed Friday in U.S. District Court in Santa Ana, Calif., government lawyers did not directly rebut the theory Taitz propounds that Obama was not born in Hawaii as he claims and as asserted by Hawaiian officials as well as contemporary newspaper birth notices. Instead, the federal attorneys argued that the suit is inherently flawed because such disputes can't be resolved in court and because the dozens of plaintiffs can't show they are directly injured by Obama's presence in office. "It is clear, from the text of the Constitution, and the relevant statutory law implementing the Constitution’s textual commitments, that challenges to the qualifications of a candidate for President can, in the first instance, be presented to the voting public before the election, and, once the election is over, can be raised as objections as the electoral votes are counted in the Congress," Assistant United States Attorneys Roger West and David DeJute wrote. This is all too simple. If Obama is using the Justice Dept. to petition the courts to dismiss the case it would be simple enough for a judge to say produce an original birth certificate and the case will be closed. That Obama would use the Justice Dept is proof that he has something to hide and the Atty. Gen. is complicit. Maybe the birth certificates of his children should be produced. The parents always have to indicate where they were born. Maybe his pre-presidential days were a little more honest. |

I guess this means he won't have to use his private lawyers to fight the birth certificate issue. He can now use the Justice Department. I wonder how many lawyers are being used to defend this issue? |

The justice dept. is using the constitution as a defense. They may be correct on most of these issues. Since we are a federal republic, the power is left to the electors and the individual members of congress to challenge the authenticity of the candidate. i.e. they should know whether their candidate is legally a citizen so that they can legally be nominated for proesiden. So challenges can only be made before an election. The part of this challenge that I see has important constitutional backing is the challenge by the military. Since only a citizen of the United States can be Commander-in-chief, proof would be required if that rank is challenged by military personnel. Critical to the defense of the country is the requirement that military personnel only take orders from the commander in chief. If there is doubt, then there is no military who will follow orders. The important issue needs to be solved by the courts based on the military issues. my opinion only |

From The Obama File today 9-8-2009: Stay Tuned In California, Orly Taitz will appear before Judge David Carter this morning. Taitz is challenging Obama's Constitutional qualifications to be president. She is representing the Independent Party's presidential candidate Ambassador Alan Keyes, Libertarian Party vice-presidential candidate, Gail Lightfoot, and 200 active-duty members of the U. S. military. There's that 3-hour time difference, so I expect the early reports to hit the web mid-afternoon, eastern time. I'll be watching the web and will be posting as soon as there is something to report. Will another judge tell the American People that they don't have "standing" or will Taitz at least get a hearing? |
