Thanks for an outstanding summary of the SANE discrepancies. I am still trying to find out what parts of Levicy's notes went with the kit specimens and which were turned in later. We do know that her fabricated nursing notes were not turned in until April. |

Sure I can. If anyone believes that DUMC. one of the finest medical facilities in the USA, is hiring nurses that can't find the pencils, they are totally unaware of Hospital standards. Only the best and brighest are hired for the ED and that includes Levicy. ER is an accurate depiction of what actually goes on in an ED and does anyone see the nurses leading the Doctors around by the nose and telling them how to practice medicine. Well no, they don't. Anyone see the Doctor's conferring with the nurses over the diagnosis or treatment. Well no. Many of you have been in the ED. Anyone have personal experience of the nurses running the show? Let alone a nurse who has a Part Time On Call job with a minor speciality? What exactly does a SANE expert witness testify to in court? I would assume they are fact witness. "Yes, I did the pelvic" "Yes, I placed the materials in the box",etc. I doubt they are asked their opinion or conclusions of whether or not a rape occured or who did it. I. obviously. have great respect for nurses but going to RN School does not a Doctor make. While nurses work hand in hand with the Docs, they are not equal partners. Noting that the susposed changed documents went from "absolutly" "to my knowledge". That is not the same and as far as I know neither the nurses or doctor's notes have ever been published so no one knows if anything was changed or altered. And if , in fact, anything was changed, if done legally - like a line through the "altered" word or sentence - Omit writtern above it and the new word or sentence substituted and initialed, thats legal. Ms Jean or any other lawyer at the bar hearing, under oath, ever questioned "altering" of the rape report put in the rape kit. Again and again this comes down to the fact that three Nursing Licencing Board have never disciplined this nurse. The Boards are very active in evaluating complaints. I can say in all honesty that EMT's have saved my life and I suspect that WERTs have saved lives on mountain tops, etc. My only quarrel is that in the USA folks are andwe Edited by Sherp, Jul 1 2009, 11:42 AM.

Aren't illegally changed documents illegal? and if no one knows if anything was changed or altered then how can they be illegal? The purpose of levicy's forced appearance at the bar hearing was to confirm nifongs lie that condoms were used. Levicy confirmed no condoms were used. It was not about levicy. |

The disbarment hearing was for Nifong, the panel members were not charged with investigation of the criminal activity of Nifong's co-conspirators. If you will remember, F. Lane Williamson nixed the Fong's mouthpiece's attempt to have Levicy declared an "expert witness" because that would have been a whole other circus, and it wasn't necessary. Levicy was a fact witness in an (administrative) disbarment hearing, not a witness in a civil or criminal case. Funny, isn't it, her 'facts' kept on changing...(just as Brodhead admitted, and told us)...to fit Nifong's slowly evolving theory of the case - a theory that was non-existent at first since he told us repeatedly he purposefully had no knowledge of any facts of the case, but just his theory, that - each and every time - was coincidentally changed to counteract or nullify or explain every defendant-favorable fact and alibi released by both the prosecution and the defense. She was not a dispassionate medical professional testifying to scientific certainties based on objective criteria. Sherp, I finally agree with something you say. SANE nurses are not supposed to come to conclusions or make diagnoses. Yet this is precisely what Levicy, the rookie SANE wannabe, did! She was not qualified to make a diagnosis of "blunt force trauma." She was not qualified to say that Crystal's exam was "consistent with a sexual assault." She was not qualified to say that the exam was consistent with someone who had been raped vaginally and anally. What Levicy told the police was 1) false and 2) beyond the scope of her practice. (P.S. Do you happen to be familiar with a retired nurse who posted under the name "vegas?" |

Sherp, we all have our loyalties. But this case is replete with people who essentially are.... either a disgrace to the profession they represent....or their so-called "professions" have descended down a slippery slope into such a pervasive embodiment of moral and professional lassitude...to become a collective disgrace themselves. So which is it? In short, either Levicy is a bad nurse...or the nursing "profession" has become a sloppy, careless consortium of rule-benders and/or incompetent rogues with a CYA attitude.... more concerned with lawsuits than medicine. When you, who we might guess to have been a nurse, defend Levicy...you scare us. If Levicy is not a bad nurse, then, by your standard, a nurse that diagnoses where she shouldn't, lies to the authorities about "evidence" that DOES NOT EXIST, changes medical documents, and tries FOR MONTHS to empower a crooked DA in his quest to convict three innocent kids...is...by your standard...is a good nurse? What are you telling us here? Sherp. by the same standard, to call out Nifong, does not impugn good DA's or good attorneys. In fact, quite the opposite is true. If one of our attorneys here were to try to make the case that Nifong was just doing his job, that would imply that the every despicable maneuver, every legal stunt he employed in this case was so.... commonplace.... in the legal profession that other lawyers found them unremarkable, unworthy of professional outrage. Think about that a bit. How an attorney reacts to Nifong says a lot about the standard of ethics as perceived by his peer group. Is Gottlieb a good cop or a bad cop? If other Durham officers defend him, what does that say about the state of ethics in that police department? Is Meehan a credit to his profession? I could go on and on. When you defend Levicy, you indicate how far nurses will go to protect each other's errors...and even deliberate, malignant, intentional lies. Sherp, Forgive me but your just plain wrong. You know that nursing shortage everyone is hollaring about? Well it is being filled with people who "fast track" in. Duke does't hire "the best and brightest", I know as one of my classmates who took FIVE tries to pass the boards was hired there (once they passed). Want to know where they hired him? Why in the ER of course!. Sherp, unless your a nurse you have no clue what a new grad knows or don't. I graduated Summa Cum Laude and frankly as far as the PRACTICE of nursing goes, I was clueless. OH I had wonderful test scores, could recite tons of cool information and explain down to the bioengineering level how stuff happens but that is NOT what nursing is about. It takes a minimum of 3 to 5 years for a nurse to become truly functional. It takes a minimum of that for an ER nurse to be able to do more than the very basics. For Duke to have hired someone with ONE YEAR of nursing school and then with less than a year of on the job training and even LET them try to be a forensic nurse is a travesty. The facts are there Sherp, period. Levicy was not only incompetent, but Duke, in violation of not only their own internal policy but that of the IAFN allowed a baby nurse into an advanced practice field. Given the things she did, I can assure you it wasn't because she was a "best and brightest". |

Neat debating ploy, Sherp. Medical-chart alterations are “legal” if made in the recommended transparent manner? You jest! The issue with Levicy’s alleged misrepresentations is liability, not legality. The issues with Levicy herself are both liability and credibility. As Joan would say, raising the subject of legality is a side-step. Now tell us why you believe that Levicy is credible, and not liable. |
