The Justice Department said Monday it has removed the legal team that prosecuted former U.S. Sen. Ted Stevens from further post-trial proceedings that concern allegations of government misconduct.

... A spokeswoman for the Justice Department declined to elaborate.

The filing announced the replacement of the original team of attorneys led by the Justice Department's Public Integrity Section from "litigation relating to allegations of misconduct in this matter." The team is headed by William Welch, chief of that office, and his main deputy, Brenda Morris, who was the lead attorney in the Stevens trial. Also affected are two other lawyers in that office, Nicholas Marsh and Edward Sullivan, and two on special assignment from the U.S. Attorney's office in Anchorage, Joe Bottini and James Goeke.

Replacing them will be Paul O'Brien, chief of the Narcotic and Dangerous Drug Section, David Jaffe, deputy chief of the Domestic Security Section, and William Stuckwisch, senior trial attorney in the Fraud Section.

Defense arguments of misconduct figure into several demands for a new trial or dismissal of charges by Stevens' attorneys, mainly involving the allegations of Anchorage FBI agent Chad Joy and a witness in the case, Dave Anderson.

Joy, part of the team investigating political corruption in Alaska since 2004, said the lead agent in the probe grew too close to sources and violated policy then, with prosecutors, worked to prevent Stevens from obtaining favorable evidence before and during the trial. Anderson, the government's final witness, said he gave false testimony about a plea deal he believed he had with the government, and that prosecutors knew it.

The government has denied wrongdoing but hasn't publicly answered the allegations in any detail.

Some of this reads like leaked "spin" by FBI/DOJ:

Quote:

As the Justice Department prepares its official response to the FBI whistle-blower complaint that surfaced in the case of former U.S. Sen. Ted Stevens, people with first-hand knowledge of some of its issues, including some named in the complaint, say it represents overblown concerns of an inexperienced agent.

Calling their conduct "outrageous" as employees of "the largest law firm on the planet," U.S. District Judge Emmet Sullivan told the Justice Department attorneys Friday afternoon that they must give the documents to Stevens' legal team by 5 p.m.

Later in the afternoon, a spokeswoman for the Justice Department sent out an announcement saying, "The Government has complied with the court's order and produced to defense counsel the documents discussed at today's hearing. We will continue to litigate in court matters related to the jury's conviction of Senator Stevens."

They got what they wanted. Stevens lost the election. The attorneys will all go on with their lives. Does anyone think they will lose their jobs? What's a little thing like obstruction of justice to a career civil servant. Meanwhile, where does Stevens go to get his Senate seat back?

I don't know the evidence. I wouldn't be surprised old Ted had his finger in the pudding pie. But the withholding of evidence by the DOJ is very troublesome. I think I remember a case in Durham.

I do know this, Brendan Sullivan seldom loses and the fat lady hasn't sung yet. My bet is still on him.

The point is that federal prosecutors lied and lied and lied. They committed felonies, yet they will not lose a penny for what they did, nor will they spend a second in jail.

We have to understand that there are two sets of rules out there. There is one set that applies to federal agents and prosecutors, and there is another set that applies to everyone else. What is a crime for everyone else is just another day at the office for that criminal class known as federal prosecutors.

I don't have much time for Ted Stevens and what he represents, but when the government lies and cheats in order to convict him, that is where I stand up. Never forget that Mike Nifong lied, gamed the system, and committed one crime after another, yet never had to pay for his crimes. That is the reality of the "justice" system in this country today. There is none other. The "system" does not work, or at least it does not work for decent, ordinary people. It is a system that works only for police and prosecutors.
