Chemerinsky: Public Urination OK; As long as one is homeless

Remember Erwin Chemerinsky, the law professor who apparently had no problem with the predations of Mike Nifong? Well, one of his first acts as the new dean of the new law school at Cal-Irvine has been to sue Laguna Beach on behalf of homeless people.

There is much in his suit that is rich. Consider the following from the piece by Heather MacDonald:

But residents and business owners complain of some vagrants' increasingly disruptive behavior. Winos drink outside of stores, then urinate and defecate on sidewalks, planters and walls. Homeless people fight among themselves and curse out other residents who complain.

John, a 58-year-old drifter sitting on a bench outside of City Hall, told me that in his six-and-a half years living on Laguna's streets he's had "only favorable interactions with the police but nothing but bad experiences with other homeless." Indeed, just four days before John and I spoke, a 230-pound man whom the police had taken to mental-health treatment numerous times grabbed a girl jogging on the beach, promptly smacked another girl in the mouth, then punched this second victim's father when he tried to intervene.

Now, I do recall that the good leftists of Duke University and Durham County were aghast -- SHOCKED -- that some of the lacrosse players might have peed in the bushes at times, late at night. But, until now, I had no idea that such activity really is constitutionally-protected, AND IT TOOK A FORMER DUKE FACULTY MEMBER TO TELL ME!

My question is this: If such activity is protected by law, then is this something Chemerinsky only "discovered" after moving to California, or was he aware of such things when he was a Duke law professor, but chose silence? Hmmm. Inquiring minds want to know!

Having lived in SF and spent many a day enjoying it I have seen what the vagrancy problem has cost it. The smell of urine can be overwhelming in some storefronts. I am not unsympathetic to a person who suffers misfortunes in life but I believe in what Ben Franklin said

Sloth makes all things difficult, but industry, all things easy. He that rises late must trot all day, and shall scarce overtake his business at night, while laziness travels so slowly that poverty soon overtakes him. Benjamin Franklin

I sure need a kick in the butt sometimes to get moving, but bringing Danishes and coffee every morning? That isn't help. That's free room service.

As for urination, the overwhelming majority of us including Duke students find a toilet.

Soon will be hearing that Chemerinsky has created a new program of study on the complexities of life as an exotic dancer. These creatures of the night must be allowed to bring false accusations, commit financial shakedowns and live to write about it as a way to supplement their income in hard economic times.

What is utterly shocking in this is that Chemerinsky was no where to be found when three innocent young men were about to be convicted of a crime they didn't commit and carted off to prison for 30 years. Now we find that his ire is up over the rights of the homeless. Give me a break!

A year or two ago I posted the link to the decision of CJ Durham of the Utah Supreme Court on the art form known as stripping. She is also a member of the Duke BOT. So that topic has been covered by one of the people responsible for the frame, whether or not the ladies are.

Yes, each member of the BOT is, personally, "one of the people responsible for the frame."

From MacDonald's article:

"Shrill, occasionally ungrammatical, and devoid of factual support for its sweeping accusations, the complaint could only have been written by someone who hasn't observed this city's police-homeless interactions, or who is blinded by ideology."

I haven't read the lawsuit but I would not be surprised if this description is accurate. It is, sadly, exactly what I expect from the likes of the esteemed Dean Chemerinsky. I'm not sure if those who are "blinded by ideology" tend to be a bit on the stupid side or if they just can't be bothered with minor things (like facts or rules) because they are so morally superior.

Let's give them a break. Remember that the facts keep changing, as Brodhead assured Ed Bradley. We can't expect them to keep up with the latest changes. :uhoh:

So true, Payback. After all, in the Age of Obama the homeless, the grifters, the lazy and worthless, the folks who have invested a lifetime sitting on their front porches waiting on the mail to come are now the elite class. The rest of us smucks who still believe in the old fashion idea of work and accomplishment are now distained. It's hard to tread water these days let alone swim against the tide.

Always remember this: For more than a year, a corrupt prosecutor abused his powers, and he did it in broad daylight. Chemerinsky saw what was going on, and said nothing. His silence, as far as I am concerned, signaled his support.

So, he moves across the country and suddenly he is concerned about how the police treat people around him. To him, Reade, Collin, and David meant nothing. They were students at the university where he taught; in Irvine, the welfare of students and others mean nothing to Chemerinsky.

He only cares about people through whom he can make a political statement. And now he is a law dean. You can be assured that the hires he makes there will be people who disdain law as much as he does.

California is virtually bankrupt. There may not be enough money for Chemerinsky to build the law school of his dreams. If he's smart, he will invest his political capital in something beyond homeless porch pissers.
