I see we are fired up! Nothing like the roasting of the disgraced, disbarred, and former DA Nifong to get a Blog Hooligan's Blood flowing. How sweet it is to see this man walk the plank. That smirking little tyrant who held the fate of the 2006 Duke Lacrosse Team in his wretched hands. It is one thing for a prosecutor to make an honest mistake, but it is another to deliberately frame innocent men. I agree with Bill that we should hold DAs & Police responsible for their illegal actions. Surely we can promote honesty & integrity in our Justice System. As for the world's greatest self proclaimed Durham ex-attorney, what do you think is his next action? a) Assume the fetal position sucking his thumb b) File a one word response, "So!" I agree with everyone. It would be one thing if he had been overzealous but honest; while the actions would not be excusable, at least one could understand them. However, what we saw was a sociopath, a pathological liar in action. The crocodile tears cried by Jan Paul and Ronald "Roland Friesler" Stephens had no effect on me except to make me more ill. All of us have known sociopaths at one time or another in our lives. They can be charming and often are pretty intelligent, but sooner or later they are exposed. You cannot tell me that for all of the years Nifong worked in the DA's office, his dishonesty was not there for others to see. We already know about his bizarre behavior dealing with traffic cases, and his screaming outbursts in the LAX case, especially the outburst against Kerry Sutton in front of an elderly legal secretary, which also would indicate psychopathic tendencies. In fact, one of the parents of the accused who was sitting near Nifong during the infamous December 15 hearing told one of her friends that Nifong looked psychotic. He certainly is someone who seems incapable of shame and is constantly trying to probe to find a way out of getting into trouble. You cannot tell me that these sick qualities of the man somehow were dormant until the lacrosse case fell into his lap. Instead, I think that the other prosecutors and the police were perfectly happy with this kind of unpredictable human volcano in their midst. He was useful, and because he could enjoy immunity, it did not matter if he lied or abused the law. In fact, such qualities would work in his favor as a prosecutor. This obviously is not meant as a compliment to those who worked with him. They were complicit in the LAX frame and they would have been perfectly happy with a wrongful conviction. These are not good people; they are animals, or, to use the term coined by the execrable Houston A. Baker, "farm animals."

The telling moment of this case, as far as I am concerned, came when Nifong changed the charges in late December, 2006, right after having been caught with his pants down. He sent Linwood Wilson to conduct an even more crooked "lineup" than had been done April 4, and he totally changed the story and timeline. Of course, being that the evil Irving Joyner and satanic Wendy Murphy endorsed what Nifong did does not say much about their character. In fact, what kind of a court system would just accept what Nifong did, as did the system in North Carolina. Do you want honesty in the system? Then take away the immunity from prosecutors, police, and judges, and I can assure you that the cockroaches would run and hide.

After that December when nifong changed the timeline and charges I remember joyner saying that it would make the case easier to prove since DNA was not required. It actually sounded like joyner was admitting that the case was not winable if nifong kept the rape charges intact. Joyner was as guilty as anyhone knowing the charges were false. It also showed his hate for people of lighter color. |

With all due respect to Bill Anderson, he paints with too broad a brush. There ARE honest police and prosecutors. I have a relative who is an assistant DA in a state other than NC. He is overwhelmed by too many cases, too little staff, and lazy judges. He works for a salary far less than other lawyers with his years of experience. He does his best in what he admits is a flawed system. There are also good police-- even in Durham (Lt. Shelton comes to mind). Certainly the bad apples should be punished, and severely. But the vast majority of police and prosecutors are over-worked, under-paid, and fighting to keep society safe. |

We have had this particular debate many times. Of course there are some honest cops in Durham. And there are some honest DA around, but not in Durham. The telling thing - and we all remember how it was in April and May of '06 - was that virtually NO ONE in Durham was able or willing to speak up and put a stop to the lynching. We should all re-watch High Noon from time to time. |

It struck me as I read this. When I think of witness intimidation in this case I always just think of Elmo but oh yeah, Kim too. I always knew about her change in story but I never really thought through the full impact of that. It reminded me of a law school torts prof who used the Titanic as a final exam question. He thought he would have to embellish the story, make up some details to cover all the issues he wanted. Turned out the more he looked at the actual events and those involved, the more tortious conduct he found. More than enough for about two thirds of a three hour exam. That's the way it is with this case. The more you look, the more wrongful/criminal conduct you see. |

Yes, I typed that up quickly and didn't differentiate between the "witness intimidation" of Kim Roberts and the subsequent "witness tampering" that occurred with respect to her statements. By "witness intimidation", I was referring to the fact that right after she gave a very detailed account to Himan of what happened that night -- which destroyed the case that they were trying to mount -- she was served a subpoena. See Himan's notes below. I believe that it was "witness tampering" later when Nifong offered Kim Roberts a sweet deal in exchange for her to disavow her previous statement and allow for a longer period of time that she was away from Mangum. 3/20/06 1010hrs - Contacted Kim Pitman reference this case. She stated that she did dance at 610 North Buchanan, I asked her if she knew anything about why I was calling. She stated that she was told that she would be getting a call from the police about an incident that took place. She stated that she heard that Ms. Mangum was sexually assaulted, which she stated is a “crock” and she stated that she was with her the whole time until she left. And the only time she was alone was when she would not leave and that time period was less than five minutes. We made an appointment for her to meet me at station 2 and have her give me a statement regarding the incident. 3/22/06 - 1240hrs Kim Pittman came into to talk about the incident. Kim stated that she was called from her escort service by Melissa to do a bachelor part at 610 Buchanan. She stated she arrived at about 11:00 pm on 3/13/06. She stated that her practice is to get id from the person who is in charge of the party. She stated she talked to Dan F. Who set up the party. She checked his ID and she stated she thought it was a new york license that was displayed. She was then told that it was not a bachelor party but a get together amongst friends. She stated that they had told her that were on sports teams, track, baseball and they all were grad students. She stated she walked to the back of the house with Dan and Dave and entered the house through their back door. She stated she was paid $400 from Dan and waited for the second girl to arrive. She state that she met a couple of the guys and talked to them for a bit. The guys were anxious and asked for her to call Melissa because they were anxious and wanted me to check on the second girl. We were told that she was soon on her way. At about 11:30 Precious arrived and came to the back where they met for the first time. She stated she waited outside so “Precious” could go inside and collect her money she showed me her payment $400.00 and we went straight to the bathroom where my out fit was to change clothes. She stated Precious came with her dancing clothes on and did not need to change. She stated she conversed with Precious about her plans for there dance. There was a knock on the door and we were handed two drinks of equal amounts. She stated she sipped the drinks (rum and coke she thinks) but Precious cup fell into the sink dumping out the contents, she thinks the victim had a couple drinks from hers but she was not sure. She finished getting dressed and proceeded to the living room, led by dan to do their show. She stated that there were about 20- 25 young guys who were all sitting down. She stated the show began and she thought it was going pretty well, she stated precious started to see signs of intoxication at that point. She stated they continued with the performance until one of the boys pulled brought out a broomstick on us and that he would use it on us. The statement made her feel uncomfortable. She stated she raised her voice that the show was over. The commotion raised my voice to the boys and made “Precious” get irate. I went to the bathroom with Precious and told her I wanted to leave. Precious felt we could get more money and that we shouldn’t leave yet. She was uncontrollable at this point and was yelling at the boys who were knocking on the door to leave them alone. Kim stated she finally decided to leave the house. She left the bathroom grabbed her bag and exited the house with her dancing gear on. She went to car wanting to leave, but she did not want to leave Precious in there alone. She stated she changed her clothes in the car where some of the boys were coming to her window talking to her. She stated she was told by one of the guys that Precious was passed out in the back and they asked if she could go get “Precious”. She stated at that point is seemed that the guys may have been ready for the night to be over. I told them that if they could get her to my car, she would get her out of their hair. With in a few minutes, she was being helped out of the back yard and into my car. S he did not have the bag that she had come with and asked her if she had the important thing the money. She told her yes but she did not seem coherent. Precious then told her that we should go back in the house because there was more money to be made. I asked her again where her things were and she said “here”, “it’s here “but kim did not see any of her things. I made an attempt to get her things. She stated she got her things and locked the door with precious inside. She went to the back of the house to try to retrieve her bag. She stated she look around with Dan but was unable to find anything. She went back to her car and the boys “Ni*ger” to both of the girls. She called the police to report racial slurs from a friends phone (919-430-0516) she stated it was a kiwi phone. While in the car, Kim repeatedly asked Precious if she had the money. She stated that “Precious” was out of it and she tried to ask where she lived but she would not tell me. She tried calling Melissa to get a hold of the driver that dropped her off but received no assistance from her. She decided to go to 24hr grocery store and seek the help of an off duty police officer, only a security guard was there. So we proceeded to call 911. She stated the police arrived and woke her up with smelling salts, they asked her questions but was only able to mutter “no”. It appeared that “Precious” did not want to leave her car. The police stated that she was in no trouble that they would take care of her. She then states that she drove back 1602 Albany Street (see statement). Through a warrant check kim pittman was wanted for a probation violation and had gone by her previous married name of “Kim Roberts”. Sgt. Gottlieb and Inv. Clayton served the warrant. One thing that stands out in my mind is that Bell and Baker have never blamed anything on Nifong. As far as I know, they have never made any public statement critical of Nifong and his actions in this case. As far as I know, Bell and Baker have never accused Nifong of lying to them. Remember that the Baker-Chalmers Report was not critical of Nifong and did not lay the blame on him, rather the Baker-Chalmers blamed the whole thing on a breakdown in communication between the boys' lawyers and Nifong (and they did NOT blame the breakdown in communication on Nifong, even though it was Nifong who refused to meet with the players that he had indicted, either before or after they were indicted.) To me, that's a pretty good indication that Bell, Baker, Nifong, and Chalmers made a deal. I mean: think about it: Bell and Baker could have blamed Nifong for everything BUT they didn't -- they've never said anything critical of Nifong that I am aware of.
