I had sent him a file with improvements of the terms of usage and what not on the first day of the beta. He has a whole heap of improvements. Guess he just doesn't have the time to do it.

No, it's not a joke, I laughed at this first time I found out, but it seems that they are very strict on that. They identify the games sites and require a TOS in order to avoid complications (although, I have no idea what complications can arise in relationship with them, but well, better safe than sorry, right?). Also, the problem is that once listed as insecure, it is very difficult to take the site off that list.
