You need to read the "fruit of the poison tree" US Supreme Ct. decision. It states that all evidence seized illegally is not admissible in court. Additionally officers are subject to civil suit if they violate a person's rights.

Police officers do not stop people just for the heck of it. They are required to have a reason. All police searches and stops fall under the "reasonable person" rule. Simply defined this means that a reasonable person (not a police officer) viewing what the officer observed would reach the conclusion that the suspect's actions warranted further investigation.
