Pat you should take a walk down a hard lockdown ward in a state mental health hospital then tell me that you want them released. Colo, People that are kept longer than 72 hrs are appointed attorneys and their case is subject to multiple review. The realty of todays under funded mental health system is that people who should remain in custody for their own and the safety of the public are released. I can see keeping one incarcerated for more than 72 hours only if they are charged with having committed a crime and are awaiting a speedy trial and the involuntary incarceration is intended to keep them from hurting themselves or others while awaiting the trial. Otherwise, the commitment should be only by the voluntary action of the person. I really want to avoid the detention of political prisoners using the ruse of a subjective jedgment of mental illness.

Nope but they demonstrate behavior that would cause them to be a major danger to themselves or others. |

Knowing that attempted suicide or the attempt to physically harm others are both crimes, I have to wonder, if these folks have been charged with no criminal actions, how one can decide that they are either a "danger to themselves" or a "danger to others." |

My real concern is locking up those who have committed no crime but whom society has determined they "just do not act appropriately in society." |

Years ago people who's mental illness caused them to be dysfunctional even though they weren't necessarily a threat to themselves or others were often institutionalized for the good of society. You may recall the horror stories of the mental hospitals. But, in attempting to fix one problem we have created another. The huge homeless population many who have mental health issues. The bulging prison population, again many of whom have mental health issues. And, add to that so many of the dysfunctional with substance abuse problems, depending on public assistance. And, having children who often end up having the same issues. The end result is we have a mental health crisis in this country, that we need to address or things will only get worse. While the violent acts you hear about almost daily need to be addressed, they are only the tip of the iceberg. |

So, Tom, let's lock everybody up who has a dependence on nicotine, alcohol or other drug. Let's also lock everybody up who "we" don't think are "functional" in our society. Let's attempt to force behavior changes on any of those who we do not understand or with whom we disagree . I do not think so, but do have a Merry Christmas!
