Winternova! Axl Rose Sues Activision; Would you lotion Axl's ass?

Hey Winternova, as our resident Lawyererererer man I was wondering what your thoughts are on the Axl Rose vs. Activision case.

I believe it goes something like this....

Axl Rose agreed to allow Welcome To The Jungle to be used in GH3 as long as Activision did not include Slash or Velvet Revolver in any way in the game. Activision clearly used Slash in a massive way and also featured a VR song as DLC. Axl file a lawsuit 3 years after the game was released and Activision claimed the suit was outside of the statute of limitations. Now apparently Axl is suing them again because in order to avoid the first lawsuit Activision promised Axl a GH game base on GnR, or more importantly the Chinese Democracy Album which never came.

I hope all of that is correct and you understand. Just wondering what your thoughts are and whether Axl has a leg to stand on here?

Chinese Democracy WAS released. And Shackler's Revenge, track 2 off the album, was in Rock Band 2.

I meant a game based solely on the Chinese Democracy Album. Not the album itself. My bad on the wording.

Wait, Leeham's saying that Activision promised a GnR GH BASED OFF OF the Chinese Democracy album or featuring it?

Ok. Nevermind then. I thought he said CD was never released, as in the album.

Geez... Leeham, do we need to tell Gabe about our inner working knowledge on GnR?

Do we really need to tell him it's actually Mick Jagger's fault? (Seriously, it is)

No no no, the game was never released. Activision promised to make a GnR GH game that was based off the CD album.

I really think if Axl didn't fuck the band up they could have gone down as the best band of all time. They had all the makings.

Haha I wouldn't say it's Jaggers fault. He didn't tell Axl to copy his douchie ways.

Without seeing the agreement between Activision and Axl I can't determine the validity of his claims, but if the agreement was as he says it was, he definitely has a case for breach of contract.

Activision are claiming that he can't sue because he doesn't own the rights to Welcome To The Jungle or something along those lines.

Well... Who does? Geffen? Or is it owned as a collective between the original members?

I would imagine Geffen. Although I thought one of the reasons Slash left was because Axl forced everyone to sign over their ownership to the GnR name including all songs. I think Activision may be pulling a Kurgan.

Again, that's something that'll be determined at trial...if there is one. 95% of cases end up settling.

I imagine it will settle. At the moment they are scheduled for court in February of 2013.

Haha every Metallica fan I have ever met has a problem with Guns N Roses. I think it's because they know deep down that Guns N Roses are the better band. They have a lot more amazing songs. Better Vocalist, Better Lead and Rhythm guitarist, better bassist, better songwriters. I think the only area Metallica have GnR beat is in the drummer department.

Man my arms getting sore from poking this bear.

I haven't heard a whole lot of Guns'n'Roses. Only ever heard their very first album.

Honestly both Metallica and GnR pale in comparison to my favorite bands though. jester::

Disturbed isn't my only favorite band but they aren't who I was talking about here. Disturbed is my favorite for totally different reasons than the others (reason I could never explain, I can't put it into words)

Disturbed's best quality is it's vocals and lyrics but their guitar and usually drums leave something to be desired.

No, the bands I'm talking about are Skeletonwitch and Scar Symmetry. Both of them blow Metallica and GnR out of the water in like every department. :P

Just did a youtube search for Skeletonwitch and listened to the first song I made it to 1minute and 4 seconds before turning it off. That was about 3 seconds of vocal. I'm sorry but I thought it was awful. There is absolutely nothing that appeals to me about those vocals. The guitar part was OK in the beginning but then just went awful and there is nothing talented about using a double kick pedal to make it sound like your drumming at 100mph. In my opinion GnR and Metallica have that band beat in every department and I think I would rather listen to them backwards then listen to SkeletonWitch again. The song was called This Horrifying Force by the way.

I would like to state that I'm not saying you have bad taste or that you are wrong for liking them. Just that in my opinion that band is atrocious.

I wasn't even going to give Scar Symmetry a chance but I figured it was only fair. Same issue. Decent at first but as soon as they kick it up and the vocals start it just goes downhill. I will never understand that vocal style.

I know you just said you won't listen to them again but I think you should listen to at least one more song. Listen to Within My Blood, that is by far their best song imo and it's also one of my absolute favorite songs in all of meta. The solo at the end of the song is godly.

Also, try Scar Symmetry, they do a mix of growling and clear vocals and it works very, very well. Try this song.

I actually just let Scar Symmetry play a bit longer (the song is The Illusionist by the way) and when the guy starts singing properly he actually has a good voice so I don't understand why he ruins it. That small section of the vocals aside, everything else is still awful.

Ah, I see you gave SS a chance but I gotta wonder which song you listened to because they change between the two in every song and even mix it in various songs. The one I just posted is one of their best songs.

I am of the opinion that music, particularly genres like metal, are so varied that no one can EVER agree on who's the best and there is absolutely no right or wrong answer so even if you totally disagree with me I'm okay with that.

Personally I'll never understand people who don't give growling a chance and view it as either annoying or "destroying" the song. Makes no sense to me as it's just as valid a vocal choice as any other and more often than not the songs bands growl in wouldn't feel right with a non-growling or screaming version. Take Bullet For My Valentine, for example. Their song Waking The Demon has two versions: A vocal and screaming version. The vocal version sucks compared to the screaming version.

That song you posted was slightly better actually. The guy has decent vocals, again I don't see why he ruins it with that massively over the top growl. I'm not a massive fan of Slipknot but they do a good mix of the gruff and normal vocals, especially their more recent stuff.

Still though I completely disagree with that statement about them being better in every way.... I mean seriously...

That is perfection. Great Vocals, amazing lead guitar, amazing Rhythm guitar, the bass and drums keeping to a simple beat that works perfectly with the style of the song. The end solo is just epic.

My main problem is, i like lyrics. But I don't want to have to Google just to find out what the lyrics are. Those growly bits in the songs I listened to I couldn't understand a word of it. i don't see the point. Which is why I said I don't mind Slipknot because I can still understand the lyrics in a song like My Plague. it's not over the top.

Paradise City is the best GnR song I've ever heard but I've never been a fan of the vocals of GnR in general, let alone that song.

It goes to show that you can't judge every band based on one song alone. Skeletonwitch doesn't particularly change their vocal style between any of their songs but their guitar is godly in some songs like the one I mentioned: Within My Blood.

WMB's ending solo reminds me of the great solos like Hallowed Be Thy Name and Paradise City.

I can't hear lyrics very well regardless of the vocal type and always have to have a lyric sheet in front of me to know all the words, I can only catch bits and pieces even if it's the clearest vocals in the world so I guess it doesn't really matter to me anyway.

When I imagine bands like that recording I imagine them going into a studio one at a time and just playing whatever, recording it and then sticking it all together. It doesn't seem to me like there was a group creative effort involved. Bands like Metallica and Guns N Roses write the song as a band, playing things and then playing things over the top to make it sound right. And when it sounds right they go into a studio and record it. Of course I don't think thats a fact about what screamo bands do to record, it's just how to final product sounds to me. The songs don't sound like they have any heart.
