They sure won't have to. Plus in NY they get a $200 fine as a, parting gift, when they refuse to turn over that phone. Yep groups lobbied for a bill in New York that would require drivers involved in car accidents to hand over their phones to police for testing by a textalyzer or similar device. Drivers who refuse to submit their phones for testing could have their licenses revoked, and drivers found to have been texting while driving face a fine. |

People texting and driving kills more innocent people than the terrorist. |

What does that have to do with constitutional law? |

My point is there's no law at present that forces anyone to do so. Such a law would be challenged as unconstitutional. Do you have a link to the law that there's a $200 fine in NY for not turning your phone over after an accident? I'd love to read it for myself. Not that I don't believe you.

Oh no, of course not. I spoke the future, in present tense, just now for shock value of giving readers an idea of what that day will soon feel like. But as for as your post yesterday you said "would have to" as in future sense. So independent of my shock posting...I respected this thread's topic discussion and provided factual info from a futuristic perspective, in terms of the near future when at least one (1) state will have this legal requirement: "...A bill being considered in (NY State Capitol) Albany would require all drivers involved in collisions to let cops scan their cell phones to determine if..." Here's a link re the $200 fine: http://www.huffingtonpost.com/entry/textalyzer-stop-texting-and-driving_us_570fcdbae4b08a2d32b94db6 holla |

So there's no existing law for someone to turn over a phone? Which is what I said. The bill may or not pass. In the event it does, as I said before it will be challenged as unconstitutional. Which it would be. Edited by kennyinbmore, Apr 19 2016, 09:17 AM.

Nope. You didn't say anything, since no one here ever claimed that a law currently exists. |

This is a bad idea....You really don't want the cops going through your phone without a warrant |

You idiot, stick to naming yourself after mens' rectum. The cops aren't going to go through your phone, as the device can only detect how long ago a text msg was accessed or sent from a device. |
