I can't see how these lads could be convicted of incitement to hatred, as they were laughing and joking, and were not inciting anyone to hate, obviously no one hates Muslims more because of it, in fact the release of tension and the humour exhibited, would likely have the opposite effect and the 2006 act clearly says that there is nothing that stops us from expressions of antipathy, dislike, ridicule, insult or abuse of particular religions or the beliefs or practices.

Public Order Act 1986
Part III Racial Hatred

18 Use of words or behaviour or display of written material.
.(1)A person who uses threatening, abusive or insulting words or behaviour, or displays any written material which is threatening, abusive or insulting, is guilty of an offence if—.
(a)he intends thereby to stir up racial hatred, or.
(b)having regard to all the circumstances racial hatred is likely to be stirred up thereby..


(5)A person who is not shown to have intended to stir up racial hatred is not guilty of an offence under this section if he did not intend his words or behaviour, or the written material, to be, and was not aware that it might be, threatening, abusive or insulting.

The 2006 act was introduced to included Religious hatred on to the already existing Public Order Act 1986 Part III Racial Hatred as follows;

Racial and Religious Hatred Act 2006

29A Meaning of “religious hatred”.In this Part “religious hatred” means hatred against a group of persons defined by reference to religious belief or lack of religious belief.

29J Protection of freedom of expression.Nothing in this Part shall be read or given effect in a way which prohibits or restricts discussion, criticism or expressions of antipathy, dislike, ridicule, insult or abuse of particular religions or the beliefs or practices of their adherents, or of any other belief system or the beliefs or practices of its adherents, or proselytising or urging adherents of a different religion or belief system to cease practising their religion or belief system.

The Gateshead six will not be prosecuted there is no case to answer. There will be lawyers lining up to defend them because it is potentially a high profile win.

Have they actually been charged by the police or the CPS? For any prosecution to go to court under this act requires the approval of the Attorney General.

If this goes to court, I'm pretty sure that the judge would throw it out, or the jury would not convict.

But whatever happens, we need to start looking into making official complaints about the police wasting time and using this law for the purposes of harrassment. This is the 4th time this law's been used, and each time it's been used to protect islam.

In fact, I don't see why there's not a case for some kind of review of this law itself. The fact that it was tied to a Bill against islamic terrorism, shows that the protection of islam from criticism has been its purpose all along. This has now been borne out in practice.

We should get ready to see those who support the islamization of Britain starting to push for a new law, one without any freedom of speech clauses. Blair's pro-islamization party did try to get the current law through with no freedom of speech clause.

We all have to be grateful to the House of Lord's for defending our freedoms against a totalitarian government. As a left-winger it sticks in my gullet that it's the House of Lords that is the only part of parliament that wants to defend freedom of speech.

Which is why Blair wanted to 'reform' the House of Lords, as they are not directly tied to a party and therefore can make informed decisions, not fall in behind a three line whip.
