Electoral Procedures Amendment (Preferential Voting) Act 2014

An Act to amend the Electoral Procedures Act 2014 to broaden the scope of forum-hosted Cabinet Elections, and for related purposes.


WHEREAS the Electoral Procedures Act 2014 (‘the Act’) intends for Cabinet Elections to be conducted on the forums of the Democratic Socialist Assembly wherever possible:
AND WHEREAS the provisions of Chapter IV of the Act make this impossible for most elections:
AND WHEREAS it is expedient that this issue be rectified:
BE IT THEREFORE ENACTED by the Members of the Congress of the Democratic Socialist Assembly, as required by the Charter, as follows:

Chapter I: Preliminary
1. Short Title
This Act may be cited as the Electoral Procedures Amendment (Preferential Voting) Act 2014.

2. Effective Date
This act shall come into force upon its passage.

Chapter II: Amendment
1. Chapter II, Clause 2 of the Act is amended as follows:

If an there is an election for a position with one or two candidates, there shall only be one poll for this position, and the voters may either vote for a single candidate or abstain.

2. Chapter II, Clause 3 of the Act is amended as follows:
Quote:
 
Elections with more than twoone candidate shall be conducted by poll instant-runoff voting, as given in Chapter IV of this Act.

3. Chapter IV, Clause 1 of the Act is amended as follows:
Quote:
 
For each position inIn an instant-runoff election, there will be different numbers of polls depending on the number of candidates running for a position.each voter may choose which candidate they would like to vote for as their first choice, second choice, and so on up to the total number of candidates for a given position.

4. Chapter IV, Clause 2 of the Act is removed:
Quote:
 
For one position, there will be the same number polls as the number of candidates, and the each poll shall be titled first choice, second choice, and so on.

5. Chapter IV, Clause 3 of the Act is removed:
Quote:
 
Each voter may choose which nation they would like to vote for as their first choice, in the first choice poll, up through the total number of choice polls for a given position.

6. Chapter IV, Clause 4 of the Act is amended as follows:
Quote:
 
At the end of the voting period, the votes in first-choice pollfirst preference votes are tallied. If one candidate has received a majority of the first-choice votes, he or she is elected.

So this is basically a recognition of the new poll format. It's a shame its not easier to create a good complex poll- its almost as if this sort of activity isn't be properly catered too.
The amendments agree with me, though I'll have to give a second look later as I have a tendency to miss flaws pretty easily.

This looks quite reasonable to me at first glance. I'd also remove the word "poll" from Chapter II, clause 3, but that's the only thing I notice at the moment.

This looks quite reasonable to me at first glance. I'd also remove the word "poll" from Chapter II, clause 3, but that's the only thing I notice at the moment.
I was mainly looking for logistical problems in the Electoral Procedures Act, but upon closer inspection, that ‘poll’ does seem quite out of place. I've edited the amendment accordingly.
