Author : Chris Gardner Co-Sponsor : Bob Lennox, Jack Scott, Benjamin Thomas, Jim Swanston, and Maya Andrha Patel. I. Aim A. The aim of this bill is to ensure worker's the right to a secret ballot when deciding whether or not to unionize. II. Secret Ballot A. A secret ballot is defined as a ballot from which no one can determine whom voted for what. B. All worker's are entitled to a secret ballot when deciding to unionize. III. Voting A. When a worker is voting no one other then the said person is allowed to be directly present. B. The only exception to this is for a family member to be present for a person, due to disabilities, who is unable to vote for him or herself. C. To preserve the process from corruption, a three member panel should be appointed representing both parties as well as an independent third party agreed upon by both parties to observe and protect the proceedings from corruption and contamination. D. When voting has concluded, said three member panel, or another method agreed upon by both parties, should be in charge of calculating the ballots to keep a fair and even perspective on the counting. IV. Intimidation A. No employer may in any way intimidate an employee into voting against unionization. B. No union or pro-union employee may in any way intimidate an employee into voting for unionization. C. If parts IV(a) or IV(b) are broken the minimum fine placed upon the perpetrator shall be $500. D. Employer and union/pro-union employee both should be permitted to openly campaign for or advocate their position as long as it does not directly go against parts IV(a) or IV(b). VI. Timetable A. This bill shall go into effect immediately after the president signs it. |
