A BILL to enable the Government to respond effectively and efficiently to combating the spread of Acquired Immune Deficiency Syndrome amongst the American population
BE IT ENACTED by the House of Representatives and the Senate of the United States
SECTION 1. SHORT TITLE.
This bill shall be cited and known as the AIDS Prevention Act
SECTION 2. PROVISIONS
1. Media
(1) The President shall, not later than 30 days after the coming into force of this bill commission such media campaigns in local and national print and broadcast media as he deems appropriate which shall be designed to highlight to the general public the following:-
(a) the nature of the illness, and, (b) common means of transmissions of the illness, and, © means by which transmission can be avoided.
(2) The campaigns specified in Section 1(1) shall be administered by the Department of Health and Social Security.
2. Education
(1) The Secretary of Education shall provide for a course of learning in public schools which shall focus on the area of sexual and health education.
(2) The curriculum shall be set out by the Department of Education or by any other body charged by law with establishing national curriculums for education.
(3) Any body establishing a curriculum for sexual and health education shall have regard to the need that that curriculum be appropriate to the age of its target students.
(4) The course of learning provided in Section 2(1) shall be available to all private schools that choose to offer it to their students.
(5) Parents of students shall have the absolute right to withdraw their child from the course of learning on sexual and health education.
(6) In establishing the curriculum, the body specified in Section 2(2) shall include in the course of learning:-
(a)education on the physical aspects of human sexuality and procreation, and, (b) education on the emotional, psychological and personal aspects of human sexuality, and, © education on maintaining of human health and of healthy lifestyles, including safe sexual practises. (d) education on the development of romantic and sexual relationships.
(7) The Department of Education shall make provision for the hiring or training of teachers to provide for the teaching of the course of education specified in Section 2(1).
3. Care Units
(1) There shall exist in such hospitals as provided by the Secretary of Health units dedicated to the care of patients with AIDS or AIDS related symptoms. (2) The Secretary of Health shall make available a minimum of $100 million for the funding of the care units specified in Section 3(1) for a minimum of 10 years and for such additional funding or additional years as may be ordered by the Secretary of Health
4. Treatment Units
(1)There shall exist in such hospitals and clinics as may be appointed by the Secretary of Health units whose role and function shall be the diagnosis and treatment of Sexually Transmitted Illness. (2) The Secretary of Health shall make available a minimum of $150 million for the funding of the care units specified in Section 4(1) for a minimum of 10 years and for such additional funding or additional years as may be ordered by the Secretary of Health.
5. Research (1)There shall be established a National Illness Research Institute which shall be funded from public funds as well as from private investment which shall co-ordinate research into illnesses as dictated by public need. (2)The NIRI shall be managed by a Director appointed by the Secretary of Health. (3)All results of the NIRI shall be deemed to be property of the President
6. Sexual Health Centres and Family Planning Clinics (1)There shall exist a national network of establishments which shall provide the following services:-
(a)advice and support to clients seeking it in the areas of sexual health and family planning, and, (b)provision of contraceptives as appropriate and on a non-profit basis, and, ©conducting local education and awareness campaigns as appropriate.
Blood Donation and Transfusions
7. Required Information Any body or organisation, public or private, which is the recipient of donations of blood shall require the following information from donors:-
(a)date of their last sexual encounter in which they engaged in either oral or vaginal sexual intercourse which was carried out without the use of a condom, and, (b) date of their last sexual encounter in which they engaged in anal sexual intercourse with or without the use of a condom, and, © any contact, sexual or otherwise, with any person which is likely to have given rise to increased risk of contracting the AIDS virus.
8. Prohibited Donors The following persons shall not be eligible to donate blood for use by a public or private institution for a transfusion:-
(a)any person who has engaged in accordance with Section 7(a) within the previous six months with a person other than their spouse or long-term and monogamous partner, and, (b)any person who has engaged in accordance within Section 7(b) within the previous 12 months with a person other than their spouse or long-term and monogamous partner, and, ©any person who has engaged in accordance with accordance with section 7© within the previous twelve with any person.
SECTION 3. ENACTMENT.
This bill shall be enacted upon the President's signature.
